The North Carolina League of Municipalities surveyed cities and towns to learn the extent of local smoking ordinances. Of 520 surveyed, 390 responded, and of those, 244 (62.6%) do not have a smoking ordinance.

A 1993 state law and a N.C. Court of Appeals decision limit what local governments can do to regulate tobacco use. However, some power is held locally; for example, up to eighty percent of public space can be designated as smoke free.

On May 19, 2009, Governor Beverly Perdue signed legislation that makes significant changes in the laws governing smoking in public places. Wall provides some background and history on the state's smoking law; discusses smoking prohibitions as they now exist and after the new law takes effect; and discusses the expanded authority of local governments to regulation smoking within their jurisdiction.

The Durham County Board of Commissioners unanimously approved a measure to ban smoking on sidewalks and trails, bus stops, parks, and other publicly owned property. Passed in February, the ban goes into effect later this month and violators will be charged a $50 fine if caught smoking any tobacco products in the newly protected public areas.

Abstract:
Restrictions on public smoking have become an issue in North Carolina, following the release of information about the harmful effects of exposure to environmental tobacco smoke. North Carolina courts have not yet been asked to decide the validity of smoking regulations. However, several cities have enacted smoking ordinances, relying on their delegated police power from the state.

The state-wide smoking ban in restaurants and bars is proving difficult to enforce. The Legislature gave no money for enforcement and the NC Division of Public Health does not have the manpower to enforce the law. Currently, citizens and business owners are the ones enforcing the law. A look at how the counties in the Triangle area will attempt to enforce the ban with their budgets is explored.
