opinion. The new trial will be
held here and it will probably be as
hard as the former, trial.
It will be recalled that S It. Pol-
lard ill January of this year shot the
chief of police when the chief entered
bis store. The jury convicted Pollard
of manslaughter and the trial judge
sentenced him to live years Eleven
lawyers represented Pollard. The
case now goes back for a new trial,
the opinion being written by Jostles
Clark for the court. Chief Justice
Clark dissents.
The evidence is conflicting but it
seems that Pollard and the Chief of
Police had bad feelings towards each
other and the Chief had threatened
to arrest Pollard for gambling and
selling liquor in his store. On
night in question, the Chief entered
the store and went over near
Pollard was. Pollard told the Chief
that he had ordered him to keep out
of his store and told the Chief to get
of his store. The defendant's
was that the Chief put his
band to his hip pocket, assumed t
threatening attitude and cursed him
and be shot in self defense. The
