The original Court records of this case have disappeared from the Supreme Court Case files at NC Archives. Thankfully this case was microfilmed and found in the Records of the States of the United States (N.C. F.1, reel 11) located in the NC Collection, J. Y. Joyner Library, East Carolina University, Greenville, NC. This landmark case defines the relationship between various Whitehurst men. Simon Whitehurst, Batson Whitehurst , John Whitehurst (of Georgia) and Daniel Whitehurst, were all sons of Simon Whitehurst, Sr. Batson Whitehurst left a son named Charles Whitehurst (of Pitt Co.) and Daniel Whitehurst left a daughter named Nancy Whitehurst Kelly (of Martin Co.). The case also mentions Frederick Bryan, Matthew Brinkley, William P. Haughton, Auterson Kelly, Henry Hunter, Samuel Williams.
