The 2000 NC General Assembly made few substantive changes in the state's criminal law and procedure. The most significant criminal legislation involved the legality of video poker machines and the procedure for forfeiture of bail bonds. The Assembly also reorganized crucial part of the administration of the criminal justice system--indigent defense.

This bulletin supplements the 1999 edition of the Institute of Government book, \"Punishments for North Carolina Crimes and Motor Vehicle Offenses.\" It covers legislation enacted by the NC General Assembly during its 1999 - 2000 session and cases decided by the NC appellate courts through September 2000. The bulletin is divided into three parts--structured sentencing and related laws; punishment chart for crimes; and punishment chart for motor vehicle offenses.

In North Carolina the motion for appropriate relief (MAR) is a single, unified post-trial procedure for raising errors made during a criminal trial. Both defendants and the State are permitted to file MARs. One procedural issue that arises in connection with MARs is whether they can be resolved on the filed papers or whether hearings are necessary or required. This bulletin addresses that issue, setting out the law governing when a hearing is required on a MAR and discussing the related issue of the showing the movant must make to succeed on a MAR.

The 2001 NC General Assembly is still in session; however, one piece of legislation passed by the Assembly is of interest to sheriffs. That is an amendment to Rule 4 of the Rules of Civil Process which extends the life of a summons from thirty to sixty days to allow the sheriff more time to find the defendants and serve the process on them. Another piece of legislation for sheriffs is still working its way through the legislative process.

The 2001 NC General Assembly made few substantive changes in the parts of the Juvenile Code that relate to delinquent and undisciplined juveniles; however, it did create new requirements for periodic judicial review of cases in which these juveniles are placed in the custody of county departments of social services. This bulletin describes these requirements and other legislation.

There were no major overhauls by the 2001 NC General Assembly in the field of criminal law and procedure; however, it did produce some significant changes. Possibly the most important legislation was in the death penalty area, with the Assembly sparing the lives of mentally retarded people and allowing prosecutors greater leeway in choosing between seeking life imprisonment or death as punishment for first-degree murder.
