Fourteen years before the US Supreme Court decided the famous Darmouth College v. Woodward case North Carolina's highest court decided a similar case and reached similar conclusions. Only a handful of Tar Heels are familiar with this North Carolina first.

Abstract:
In Horner v. Chamber of Commerce, the Supreme Court of North Carolina handed down a decision which is very likely to have far-reaching effects upon local government. It was decided that attorney's fees may be recoverable if a taxpayer takes action against counties, cities, or towns that have illegally expended funds.
