The expansion of Medicaid coverage and rural health services were among eighty recommendations of the North Carolina Health Planning Commission in 1994 to the General Assembly. Medical tort reform was the recommendation that received the most attention.

After being dismissed from Duke Hospital for allegedly refusing to commit perjury in a malpractice trail, Marie Sides is suing for wrongful termination. But first, she had to secure a precedent-setting ruling from the North Carolina Supreme Court for the right to sue on those grounds. The ruling was needed because North Carolina employers can fire non-contractual employees for any reason, including their refusal to do something unethical.

Abstract:
An increasing factor in medical malpractice lawsuits is the after-the-fact conclusion that the physician did not obtain informed consent or disclose information to the patient. If carefully designed, the hospital consent form could serve as a valuable check on the patient’s understanding of medical procedures.

Medical malpractice has not yet become a serious problem in North Carolina, but nationally, the frequency of lawsuits and claims has greatly increased. This liability crisis has resulted from cases of negligent care, suits brought upon by professional colleagues, media publicity, impersonal doctor-patient relationships, and absence of trust.
