Abstract:
Henry Wilkins Lewis served as a faculty member at the Institute of Government at the University of North Carolina at Chapel Hill from 1946 to 1979 and as director from 1973 to 1979. Lewis graduated from UNC in 1937 and earned a law degree from Harvard in 1940. He practiced law for one year in his hometown of Jackson, and then served in the U.S. Army for the next four and one-half years. At the Institute, Lewis spent most of his career in election law and property tax, becoming the preeminent authority on both subjects.

This bulletin reviews legislation passed by the 2000 session of the NC General Assembly that is of interest to registers of deeds. The legislation is identified by the session law chapter number, with the original bill number given in parentheses. Unless otherwise indicated, the acts became effective when ratified and are therefore current laws. Among the bills enacted were security of electronic records, electronic signatures, and a rewrite of Article 9 of the Uniform Commercial Code.

Abstract:
This bulletin discusses a U.S. Court of Appeals case that struck down previous cases that upheld against Commerce Clause challenges various local government arrangements that required municipal solid waste to be collected by a single hauler or disposed of in a designated facility. In Huish Detergents, Inc. v. Warren County the Court of Appeals for the Sixth Circuit decided such an arrangement imposed a flow control regime contrary to C&A Carbone, Inc. v. Town of Clarkstown. This case, along with others that preceded it, offers some useful lessons to local governments in how not to structure exclusive hauling and disposal arrangements.

Campbell discusses the 1999 ruling of the North Carolina Supreme Court in Smith Chapel Baptist Church v. City of Durham. The court decided that Durham's storm watch fees were invalid because \"they were used to finance programs not authorized by the enabling statues.\"

Abstract:
This bulletin discusses the recent Fourth Circuit Court of Appeals decision in NVR Homes, Inc. v. Clerks of the Circuit Courts (IN RE NVR LP) and its effect on the collection of the North Carolina real estate excise tax when the grantor in an instrument transferring an interest in real property is a debtor in a Chapter 11 bankruptcy proceeding. The consequence of the decision for the state's registers of deeds is discussed.

North Carolina statutes give cities and towns limited authority in the process by which permits are issued for the construction and operation of sanitary landfills, an authority that is relatively new and is untested in court. This bulletin analyzes the role given local governments and concludes that they have not been granted the unrestricted power to veto a permit application for construction and operation of sanitary landfills.
