Dear Mr.Hearne: I have your letter of January 21. I received the deed to Mrs. Hearne and it has been recorded. Likewise, the deed from Mrs. Hearne to the other heirs has been recorded. The stipulation in which you and Mrs. Hearne withdrew from the partition proceeding has been filed with the Clerk of the Court. I am advised that the remaining three heirs will decide within a few days as to whether or not they will proceed with the proceeding now pending. As soon as a decision is reached and the amount of the costs can be ascertained, and the proportion of the costs to be paid byyou and Mrs. Hearne is determined, I will advise you. At the end of the year I presume the rent for the Pearsall house will be accounted for by the persons who are to pay for it. I have not been advised that I am to draw the rental contract. You may advise me about this. There is nothing that can be done about taxes assessed in the past. You will have to wait until next spring when the property is listed for taxes. At that time you should request an appraisal of the property by the local appraisers and if they refuse to grant you one, then you can appeal to the County Board of Commissioners.
