After the witnesses<lb />~were sworn the defense requested the<lb />court to have the importact -witnesees<lb />separated to prevent one hearing ~what<lb />the other testified to.<lb /><lb />The first witness the State introduced<lb />was Willis Crandall, a brother ef David<lb /><lb />Crandall, deceased, who testified ~as<lb />follows :<lb />On Christmas morning all of us<lb /><lb />started rabbit hunting. Keel proposed<lb />wrestle with Butler, and Butler object-<lb />ed. Keel ran into Butler anyhow, and<lb />Butler threw him. Keel took out his<lb />knife end commenced cutting at Butler,<lb /><lb />{put krife back in his pocket and struck<lb /><lb />Butler across back with gun. Keel<lb />then shot at Butler but Butler knocked<lb />the gun up so it was discharged in the<lb />air. Keel then snatched a gun out ot<lb />David CrandallTs hands and said oG-d<lb />d"n you, ITll kill yoa too,� and shot<lb />him. Keel was standing about three<lb />steps from Crandall when he shot him<lb />( Witness took a stick and showed posi.<lb />tion and distance parties were apart at<lb /><lb />| time) of shooting. Butler<lb />knocked gun up when Keel shot at him,<lb />I had taken a drink that morning. I<lb />never stated that I was so intoxicated<lb />tbat, morniug that I did not know what<lb />occurred. I was not tight. Keel took it when we got<lb />near SheppardTs,<lb /><lb />morning. carried<lb />I went home nght<lb />after shooting.<lb /><lb />Re-direct examination"~Lhe trouble<lb />between David and Keel was about<lb />some cattle, it occurred about two<lb />months betore the shooting.<lb /><lb />Stanley Warren"Myselt and Butler<lb />started rabbit hunting, on the way we<lb />4 met David and Wiliis Crandall, Wynne,<lb />Keel and.a litte boy. We went down<lb />near SheppardTs mill. Keel, Butler<lb />and David Crandall were walking close<lb />|together, Keel said something about<lb />Crandall said he diduTt<lb />wrestle, DonTt know what Butler said,<lb />Keel took hold of Butler and they fell.<lb />They got up and Butler threwhitn,when<lb />they rose from this fall Keel struck at<lb />Butler several times and said oWhere<lb />ig my gun?� I did not see him get gan<lb />and did not see him shoot, but heard it<lb />fire and when I looked around I saw<lb />Keel strike Butler across the back with<lb />gun, he then took out a knife and<lb />struck at Butler several tithes. Butler<lb /><lb />wrestling.<lb /><lb />THREE BUILDINGS BURNED.<lb /><lb />Fire Bugs.Destroy the Dancy Corner<lb />arid Give the Town a Close Call"<lb />Engine Failed to Work.<lb /><lb />The new fire bell had an opportunity<lb />Friday night of sounding its first alarm.<lb />{t was about a quarter past 11 oclock<lb />whea the rapid clanging of the tell<lb />aroused our people and told them there<lb />was fire, and soon had them hurrying<lb />out to the street.<lb /><lb />The fire was in the confecion store of<lb /><lb />Morris Meyer and burning rapidly<lb />when the ciowd arrived. The fire<lb />eugine was promptly at the cistern and<lb />a jjne of nose run out, but owing to<lb />some trouble in the engine it would not<lb />work and could not throw water. Sev-<lb />eral efforts were made to fix the eugine<lb />and get it to work but without avail:<lb />All this time the fire was gaining<lb />rapidly and it was apparent that the<lb />building could not be saved.<lb />' Realizing that something must be<lb />done to prevent a general conflagration |<lb />the people and the hook and ladder<lb />company set to work with a wili and<lb />did heroie service. Fortunately there<lb />was plenty of water in the water cistern,<lb />but there was difficulty in getting it out<lb />until a pump was put in.<lb /><lb />From Morris MeyerTs store the firé<lb />went to the old Dancey building and vo<lb />L. Hooker &amp; CoTs. bar on the corner,<lb />totally destroying these. Everything in<lb />Meyer's stu.e was lost, vut Hooker &amp;<lb />Co. saved most of their goods. Meyer<lb />hid $900 on building and stock, but<lb />Hooker had no insurance on either.<lb /><lb />The large double stores of J. B.<lb />Cherry &amp; Co. across the street was<lb />badly damaged. I was im.<lb />dicted about fifteen years ago for inde-<lb />cent exposure of person on public.road.<lb />and convicted. Was whipped about it<lb />previously. Ihave not told any one<lb />that Keel shot Urandall aceidentally.<lb />Dr. E. A. MoyemI was special<lb /><lb />| coroner to hold inquest over the body<lb /><lb />of David Crandall. He is sick in<lb />bed, bad off, and is not able to attend<lb />this trial,<lb /><lb />J. A. Lang"[ am the Justice of<lb />the Peace who tried this case at pre-<lb />liminary hearing.
