Old man JimT Ward<lb />and Lumas Peyton lived in the house<lb />and Lumas had built a.big fire in the<lb />rickety stove and left it. The.whole<lb />roof of the shanty was in flames when<lb />|discovered, but our firemen responded<lb />promptly to the alar m and soon had the<lb />fire extinguished. !<lb /><lb />The alarm had a disorganizing effect<lb />upon the churches which were in the<lb />{midst of services at the time. Rev. H.<lb />B. Anderson, who was to preach at the<lb />Methodist church, had just announced<lb />| his text and subject when ihe congre-<lb />gation sprang up and rushed out, and<lb />the service was notT completed. The<lb />deacons at the Baptist churck were just<lb />finishing up che collection when the<lb />people run out and left them oholding<lb />the bag.� After learning where the<lb />fit Was and that it was only slight,<lb />the congregation reassembled and Rev.<lb />Mr. Wells preached his sermon. At<lb />the Presdyterian church Rev. E. Carr Reverses the Sentence Pass-<lb /><lb />ed by Judge Timberiake.<lb />On the 29th day of last Februa-<lb />: gy, at midnight, the store of A.C.<lb />Mitchell, of Edenton, was broken<lb />dato and robbed. A few minutes<lb />_ gfter an entrance was affected,<lb /> @hariles J. Pratt, who was then<lb />and still is a regular policeman<lb />of Edenton, was informed of tie<lb />fact. He was told that Neil Skin-<lb />ger, anegro bully, was the guilty<lb />party and had been recognized as<lb />de went into the store. Thereupon<lb />Pratt went in pursuit of Skinner,<lb />- @ummoning John Harris. and<lb /> Wilham Leggett to help make<lb />_ the arrest. They soon came up<lb />~with Sk~uner aud informed him of<lb />- heir purpose and the charge<lb /> againsthim. He violently resist<lb />ed arrest, striking Pratt a terriffic<lb />plow and severely biting Harris.<lb />The fight was a desperate one<lb />_. gnd the policemen had to severe-<lb />Jy ciub Skinner before they were<lb />able to take him intocustody or<lb />prevent his further ibjaring them.<lb />This incensed the negroes in<lb />and around Edenton, and they<lb />threatened to take the negro from<lb />the authorities. A not was imm-<lb />~ pent and Mayor Vann applied to<lb />fhe Governor for as istence. A<lb /> Wiiitary company from Hiiza-<lb /> b-th City was vhereupon ordered<lb />to Edenton to quiet the rioters.<lb />~The officers who made the ar-<lb />vost were then indicted for assault<lb />and battery with deadly weapons<lb />and were tried at the last (Sep-<lb />tember) term of Chowan Supe-<lb />vior court, Judge Timberlak» pre<lb />siding. Greatly to the surprise<lb />of everybody the facts were not<lb />allowed to zo to the jury, but the<lb />judge passed upon them, adjudg-<lb />ed the defendants guilty and sen.<lb />fenced them as follows: Pratt<lb />fo imprisonnient in jail for 12<lb />oouths, and Harris and Leggett<lb />- fo imprisonment in jail for 6<lb />* months.<lb /><lb />It is said, though L cannot<lb />» -youch for the truth of it, that be-<lb />fore doing this Judge Timberlake<lb />offered to passa very light seu-<lb />fence un the defendants if they<lb />would pay the negro arrested a<lb />certiin sum of money. This, I<lb />am informed, they refused to do.<lb />- The whole community was in-<lb />dignant at the result of the trial.<lb />Judge Timberlake was severely<lb />criticised. A petition was at once<lb />gotten up and signed by all the<lb />yest citizens of that section and<lb />y was raised by popular<lb />abscription to pay the expenses<lb />yyers to come to Raleigh and<lb />iy the facts in the case before<lb />Governor Carr, Messrs. \V. H.<lb />Bond and J. N. Pruden came. In<lb />sddition to this many personal<lb /><lb />8 wore written to the (tover-<lb />etting forth the reasons why<lb />née of the Sart ought<lb /><lb />fs<lb />(oo fis<lb /><lb />_|8upposed criminal. It was abun-<lb /><lb />| party, and went in pursuit of him.<lb /><lb />~caught the right man. Pratt,<lb />the policeman, gas informed that<lb />that the prosecutor was the guilty<lb /><lb />When caught he desperately re-<lb />sisted arrest and fought the offi-<lb />cer, who calied others to his as-"<lb />sistance. If, under these circam-<lb />stances, human beings do not<lb />exactly measure their acts they<lb />ought not to be too severely con-<lb />demned. Innocent men are not<lb />apttyv resist an officer of the<lb />law and it was a very natural con<lb />clusion to arrive at, that the more<lb />uesperate the resistance the more<lb />certain were they that they had<lb /><lb />were Only doing their duty as<lb />they knew it. In my opinion, it<lb />would be little less than a public<lb />calamity for these men, who<lb />thought they were doing their<lb />duty, and would undoubtedly<lb />have been censured and punish-<lb />ed hed they failed io arrest this<lb />man, should) suffer bumiliating<lb />punishment aud the  alleed<lb />telon go free, under she direction<lb />of the court. The crime of resis-<lb />ting an officer in the discharge of<lb />his duty 18 much too frequent.<lb />A complete pardon is hereby<lb />granted the three officers."Kal-<lb />eigh News and Observer.<lb /><lb />Such a course as Judge Timber-<lb />lake pursued shows that the peo-<lb />pie should be careful as to the<lb />kind of men. they choose to pre-<lb />side over our courts. Things<lb />are coming to a pretty pass wher<lb />an officer is punished tor per,<lb />forming his duty. It is fortunate<lb />for these officers that the Siate<lb />has a good Governor whe prompv-<lb />ly and fully pardoned them. We<lb />fear if Governor-elect Russell had<lb />been in the executive chair these<lb />men would have served out the<lb />unjust sentence imposed upon<lb />them by Judge Timberlake.<lb /><lb />A Strange Case.<lb />An accident, remarkable in its<lb />details and results vuccurred re-<lb />cently at South Boston. A num-<lb />ber of colored boys were playing<lb />base bail and were using one of<lb />the rougd upright supports ofa<lb />cane bettomed chairasa ba!. In<lb />some way or other one of the ne-<lb />groes who was atthe bat strack<lb />one of bis companions a severe<lb />biow on the forehead with the end<lb />of his improvised bat. The stout<lb />piece of wood buried itself in the<lb />negroeTs skull, and atthe time it<lb />looked as if the days of the injur-<lb />ed wan were numbered. Dr. Bert,<lb />of South Boston was valled on to<lb /><lb />the stick from the young manTs<lb />head he cuta little notch to mark<lb />the depth to which it kad penetra.<lb />ted the head.
