The first witness was ole<lb />fireman of the engine. He said he saw<lb />the prisoner get tpou the engin. and<lb />ordered him off. ~The engineer then<lb />took him by the arm and put him off<lb />easily. In getting off he dropped his<lb />hat and asked if some one would hold a<lb />light for him to get it. Engineer Dodd<lb />| held up his lantern and as he did so the<lb />negro shot him. ~Che ball entered un-<lb />der the lett nipple and Mr. Dood fell<lb />from his cab dead.<lb /><lb />The Pullman porter saw the prisoner<lb />stealing a ride on the Pullman car; he<lb />was made to get off.<lb /><lb />Officer Roberts, who made the ar-<lb />rest, said the prisoner said: oI have<lb />no pistol, and when Roberts searched<lb />kim, he then said: oYes, I have a<lb />pistol, but itTs empty. The pistol<lb />was 38 calibre, and had one empty<lb />shell, which smelled as if it had been<lb />recently shot. Dowden then said :<lb />oJf had listened to my daddy last<lb />night I would not have been in La<lb />trouble.<lb /><lb />Dowden then made a statement, af-<lb />ter being cautioned by Solicitor Daniel:<lb />He said he lett Raleigh last night.
