Garaufis of<lb /><lb />+ -Federal District Court in<lb /><lb />Brooklyn. oIt was a part of a<lb />pattern, practice and policy of<lb />intentional discrimination<lb />against black applicants that<lb />has deep historical antecedents<lb /> and uniquely disabling effects. ?<lb />A remedy will be decided on<lb />later.<lb /><lb />In his decision, the judge<lb />highlighted how oblack and<lb />other minority firefighters have<lb />been severely<lb />underrepresented, ?<lb />characterizing that as a<lb /> opersistent stain on the Fire<lb />Department Ts record. ?<lb /><lb />City officials said that they<lb />intended to appeal the<lb />decision, but could not do so<lb />until the judge had determined<lb />what damages the city might<lb />face.<lb /><lb />Legal experts; as well as<lb />lawyers for the plaintiffs and<lb />city officials, said the decision<lb />was the first in recent memory<lb /><lb />in which a court had found that<lb />the city had intentionally<lb /><lb />discriminated Sestak a fake<lb />group of people " racial<lb />minorities or women, for<lb />instance " in the workplace.<lb /><lb />- oIcan Tt recall there ever being a<lb /><lb />finding of intentional racial<lb /><lb />discrimination in a pattern-and-<lb /><lb />practice case against the city, ?<lb />said Elise C..Boddie, a professor<lb />of constitutional law at New<lb />York Law School who formerly<lb />litigated employment<lb />discrimination cases. oI would<lb />say this is pretty big. ?<lb /><lb />In July, Judge Garaufis " acting<lb />on a claim being pushed by the<lb />United. States Justice<lb />Department " ruled that the Fire<lb /><lb />Department used a test in 1999-<lb /><lb />and 2002. that had a<lb />discriminatory. effect on black<lb />applicants.<lb /><lb />In his ruling on Wednesday, the<lb /><lb />judge found that the city<lb /><lb />intentionally discriminated<lb />against blacks in using those tests<lb />and in ignoring calls over the<lb />years to change the testing<lb />procedure. The suit was brought<lb /><lb />by three people who took the test .<lb /><lb />and by the Vulcan Society, a<lb />fraternal organization of black<lb />city firefighters.<lb /><lb />At the heart of the case is the Fire<lb />Department Ts persistent<lb />underrepresentation of<lb />minorities and the continued use,<lb /><lb />between 1999 and 2007, of the<lb />entrance exams. In 2007, there<lb />were 303 black firefighters,<lb /><lb />accounting for 3.4 percent of the<lb /><lb />department Ts ranks; black<lb /><lb />residents make up 25.6 percent<lb />of the city Ts population.<lb /><lb />-., oThe judge noted that'while the<lb />city Ts other uniformed services<lb /> ohave made rapid progress<lb />integrating black members into<lb />their ranks, the Fire Department<lb />has stagnated and at times<lb />retrogressed. ?<lb /><lb />Repair arid Save<lb />1-252-756-0044<lb /><lb />3400 S.
