The<lb />decision to reopen comes on<lb />the heels of a judge Ts .<lb />ruling that the bank that first<lb />foreclosed on his building<lb />didn Tt have  oclean hands, �<lb /><lb />in the affair.<lb /><lb />Now the former Mitchell Ts<lb />restaurant on US 301 will go to<lb />public auction later this month,<lb />and Erader Mills, Jr., of Spring<lb />Hope, the investor behind<lb />Mitchell Ts Barbeque, intends to<lb />buy it back and help Mitchell<lb />reopen the restaurant. Mills<lb />and Mitchell plan to begin<lb />offering the organic barbeque<lb />that was headed to the menu in<lb />2005 when the building<lb /><lb />was Closed, Mills said.<lb /><lb />They also plan to expand<lb />Mitchell Ts to several other<lb />locations in the state in the future.<lb />Mills, who owns Erader Mills<lb />Septic Tank and Ready Mix<lb />Concrete of Spring Hope, has<lb />been friends with Mitchell for<lb />more than 20 years.<lb /><lb />The restaurant will be sold at<lb />public auction at the Wilson<lb />County courthouose on Dec) f " <lb />22, at 11 am.<lb /><lb />With interest, about $ 2 million<lb />will be owed on the building,<lb />said Anthony Brannon,<lb /><lb />attorney for Mills, from the<lb />Raleigh firm Brannon Strickland,<lb />PLLC.  oI Tm glad it Ts about<lb />over, [hope, � Mills said, In<lb />September, Mills won in court<lb /><lb />working conditions that<lb />included brutally fast<lb />production lines, crippling<lb />injuries and a climate that<lb />pitted Black workers against<lb />newly arrived low-wage<lb />Latino immigrants. But<lb />workers at the Smithfield Tar<lb />Heel plant didn Tt have the<lb />luxury because management<lb />has stonewalled their fight for<lb />union seers for over<lb />a decade. ' *<lb /><lb />when Wilson County Clerk of<lb />Superior Court Andrew<lb />Whitley authorized a second<lb />foreclosure sale of the<lb />Mitchell Ts<lb /><lb />restaurant property. But<lb />Southern Bank and Trust<lb />Company appealed that<lb />decision.<lb /><lb />Superior Court Judge W.<lb />Russell Duke Jr., upheld<lb />Whitley Ts decision in an order<lb />filed<lb /><lb />late last week. According to<lb />the order, the court,  ocannot<lb />find that Southem Bank<lb /><lb />and Trust comaony comes into<lb />court with clean hands.  o<lb /><lb />The ruling allows, Mills,<lb />through his trustee, to foreclose<lb />on Little Pig Properties Inc.,<lb />rather than the bank. Management also |<lb />acknowledged that they had<lb />misinterpreted the law and<lb />agreed to make appropriate<lb />adjustments to comply.<lb /><lb />these policies.         <p>THE MINORITY VOICE DECEMBER 2006 Pg8<lb /><lb />Retirement<lb />Celebration for<lb />Mildren Council,<lb />MSW<lb /><lb />Two retirement celebrations<lb />were recently held for<lb />Mildred Atkinson<lb /><lb />Council upon her retirement<lb />from the State of North<lb />Carolina after 32<lb /><lb />years of service. The first<lb />was a reception held<lb />October 31 at the NC<lb />Department of Health and<lb />Human Services Office in<lb />Raleigh. The second<lb />celebration, held on<lb />November 01, 2006, was a<lb />retirement luncheon at the<lb />Beef Bam in Greenville.<lb />Mildren Atkinson Council<lb />began her career as a Social<lb />Worker II at Caswell Center<lb />in Kinston. She later<lb />became a Genetic Educator/<lb />Counselor /Community<lb />Development Specialist with<lb />the North Carolina Infant<lb />Mortality Program, where<lb />she worked for four years.<lb />She retired as a Sickle Cell.<lb />Health Educator/Counselor<lb />serving patients in five<lb />eastern NC counties  "<lb />Beaufort, Bertie, Hyde,<lb />Martin, and Pitt. |<lb />Awards received during her<lb />retirement celebrations<lb />included a Certificate of<lb />Retirement from the State of<lb />North Carolina; the state of<lb />North Carolina Order of the<lb />Longleaf Pine from<lb />Governor Michael T. Easley;<lb />Outstanding Achievement<lb />Award for 26 years of<lb />Outstanding Service to the<lb />Sickle Cell Families and<lb />Citizens of North Carolina<lb />from the statewide program<lb />staff; a thank you angel from<lb />East Carolina University Ts<lb />Comprehensive Sickle Cell<lb />Clinic; a congratulations<lb />letter from Congressman G.<lb />K.
