Two<lb />weeks ago, the Democrat<lb />led State Board of Elections<lb />petitioned a three-judge fed-<lb />eral panel in Washington,<lb />DC, to review the<lb />Republican-majority = NC<lb />Supreme Court's April 30<lb />decision to strike down the<lb />Democrat-controlled _ state<lb />Legislature's House and<lb />Senate redistricting maps.<lb />The Carolinian has learned<lb />that at least one of those<lb />federal judges is a<lb />Democrat, appointed during<lb />President Jimmy Carter's<lb />administration. If at least<lb />one of the remaining judges<lb />is also a Democrat, state<lb /><lb />Republicans may have<lb />something to worry about.<lb />The State Board of<lb /><lb />Elections T hope is that by<lb />applying federal, not state<lb />law to the review, those<lb />judges will not only reverse<lb />the state High Court's ruling<lb />that the original maps were<lb />unconstitutional per North<lb />Carolina law, but strike<lb />down Johnston County<lb />Superior Court Judge Knox<lb />V. K Jenkins T subsequent<lb />maps which have been sub-<lb />mitted to the US<lb />Department of Justice for<lb />preclearance, and rule that<lb />the state Constitution's man-<lb />date not to split counties<lb />while drawing redistricting<lb />maps, is in itself contrary to<lb />the US Constitution, and<lb />violates the principle of one<lb />man-one vote, and ulti-<lb />mately the 1965 Voting<lb />Rights Act.<lb /><lb />On Friday, Democrat legis-<lb />lative leaders § House<lb />Speaker Jim Black and<lb />Senate leader Marc<lb />Basnight asked that federal<lb />panel to restore the<lb />Legislature's original map<lb />that the state Supreme Court<lb />struck down as_ violating<lb /><lb />NC's Constitution by today,<lb />Thursday. They voted that<lb />the US Justice Department<lb />precleared that map.<lb /><lb />Black and Basnight added<lb />that if Judge Jenkins T maps<lb />are allowed to stand, then<lb />many black candidates may<lb />lose because of the likeli-<lb />hood that there won't be a<lb />runoff primary if they come<lb />in second.<lb /><lb />"Without these runoff elec-<lb />tions, majority-black  dis-<lb />tricts may no longer serve<lb />their purpose of providing<lb />an equal opportunity for<lb />African-American voters to<lb />elect candidates of their<lb />choice," the Democrats mo-<lb />tion to the court said.<lb />Federal officials have never<lb />been asked to rule directly<lb />about the constitutionality<lb />of the "no splitting coun-<lb />ties" before , though the<lb />state was forced over a span<lb />of 30 years to redraw maps<lb />because lawmakers held to<lb />it. After calling the redrawn<lb />maps the Legislature pro-<lb />duced in special session<lb />"unconstitutional" without<lb />stating a reason why, Judge<lb />Jenkins substituted his own<lb />maps earlier this month<lb />which make the<lb />Republicans very competi-<lb />tive in this fall's races in<lb />both houses. Winners in the<lb />November elections would<lb />then draw new permanent<lb />maps that would, if ac-<lb />cepted, last until 2012.<lb />But while white Democrats<lb />argue that their districts<lb />have been gutted so that<lb />Republicans have a better<lb />shot at taking them over,<lb />black Democrats complain<lb />that many of them were<lb />"packed" into majority-<lb />black districts, a violation<lb />of the 1965 Voting Rights<lb />Act.<lb /><lb />Not surprisingly, __ state<lb />Republican leaders _ like<lb />Senate Minority Leader Leo<lb />Daughtry, along with others<lb />who've been patting them-<lb />selves on the back for<lb />successfully guiding their<lb />lawsuit against the redis-<lb />tricting maps from one con-<lb />servative judge to another,<lb /><lb /> Thumbs up T NFL hero<lb /><lb />aids local fund-raiser<lb /><lb />By Jenna Hunt, The Daily<lb />Reflector<lb /><lb />The relationship between a<lb />local doctor and an injured<lb />NFL football player has led<lb />to a fund-raising event to<lb />help an area nonprofit pro-<lb />gram for children and fund<lb />research to find a cure for<lb />paralysis.<lb /><lb />A dinner banquet started off<lb />the T Dream Ameriga-Mike<lb />Utley Celebrity  oGolf<lb />Classic on Friday at the<lb />Hilton Greenville. The golf<lb />tournament starts today at<lb />Bradford Creek Golf<lb />Course.<lb /><lb />Dream America is a new<lb />Greenville-based, nonprofit<lb />tutoring and mentor pro-<lb />gram for children. The pro-<lb />gram will benefit from a<lb />portion of proceeds<lb />raised during  ofirst-ever golf<lb /><lb />tournament.<lb /><lb />"Every kid deserves a<lb />chance to succeed," said<lb />Utley, who was paralyzed<lb />during an NFL game more<lb />than a decade ago and has<lb />become famous for his<lb />courage and the "thumbs<lb /><lb />up" gesture he gave while:<lb /><lb />being carried off the field<lb />after his injury. He has<lb />served aS a motivational<lb />speaker for, hundreds of<lb />children's events since the<lb />injury.<lb /><lb />Utley's fighting spirit has<lb />enabled him to regain the<lb />ability of his arms, hands<lb />and fingers and helped him<lb />lead an independent life full<lb />of adapted sports, strength<lb />training and the energy to<lb />lead his own foundation, he<lb />said,<lb /><lb />His recovery has amazed<lb />the medical community and<lb />he said he plans to keep<lb /><lb />are now concerned that the<lb />feds may cancel out all of<lb />their hard work with one<lb />stroke of the pen, and have<lb />asked this week that the<lb />State Elections Board re-<lb />quest be postponed as not to<lb />delay this fall's elections.<lb />At the rate this political and<lb />judicial drama is playing,<lb />there seems to be no guar-<lb />antees that the long  post-<lb />poned May primaries will<lb />held in late August or<lb />September as some have<lb />speculated.<lb /><lb />In fact, if the Democrats<lb />and Republicans continue<lb />to battle it out to the highest<lb />court in the land, there may<lb />be no November elections<lb />either.<lb /><lb />What happens then, espe-<lb />cially when a new General<lb />Assembly is scheduled to<lb />take office in January?<lb /><lb />"If nothing is done in time<lb />for this election to take<lb />place in November for the<lb />Legislative races, it's not<lb />inconceivable (that) the cur-<lb />rent (General Assembly)<lb />members would be held<lb />over until the next year,"<lb />Martin, who is also a 13th<lb /><lb />Congressional District<lb />candi- date, added.<lb />"That could be  constitu-<lb /><lb />tionally done if necessary if<lb />there's not enough time to<lb />hold an election, T he said.<lb />'There are several different<lb />things up in the air. We just<lb />won't know. for at least a<lb />few more weeks.<lb /><lb />"Or a few more months."<lb />That's exactly what the<lb />Democrats would love to do<lb />to hold onto power, the<lb />Republicans charged in<lb />their brief this week before<lb />the U.S. District Court in<lb />Washington,<lb /><lb />D.C..  This court action<lb />serves no purpose other<lb />than delaying the (Voting<lb />Rights Act] Section 5 re-<lb />view and creating a plat-<lb />form for other parties to<lb />attack the validity of the<lb />court's plan and the Justice<lb />Department's review, T the<lb />GOP said in their motion to<lb />hold the State Board of<lb />Elections T petition.<lb /><lb />The Republicans want the<lb />U.S. Justice Department to<lb />preclear Judge Knox<lb />Jenkins T redistricting maps<lb />first before any judicial<lb />review, and ignore the state<lb />Supreme Court's ruling, so<lb />that the September prima-<lb />ries and November elec-<lb />tions can he held.<lb />Democrats counter that the<lb />Legislature's original maps,<lb />though drawn to ensure<lb />Democratic dominance for<lb />the next 10 years, were<lb />perfectly legal under federal<lb />law because they upheld the<lb /> one man-one vote" federal<lb />principle, validated by the<lb />preclearance of the U.S.<lb />Justice Department.<lb />Besides, Democrats argue,<lb />40 counties in North<lb />Carolina that fall under the<lb />Voting Rights Act are al-<lb />ready split to ensure voting<lb />rights enforcement for<lb />hlacks and other people of<lb />color.<lb /><lb />And for the past 20 years,<lb />North  Carolina has submit-<lb />ted redistrictng plans that<lb />routinely split counties to<lb />meet federal guide-<lb />lines,without nary a whisper<lb />from Republicans.<lb />Meanwhile, members of the<lb />N.C. Legislative Black<lb />Caucus holding their 17th<lb />annual scholarship confer-<lb />ence and banquet in the<lb />Research Triangle Park last<lb />weekend raised concerns<lb />about how Judge Jenkins T<lb />redrawn maps impact ma-<lb />jority black districts.<lb />Fourth-term Rep. Flossie<lb />Boyd- McIntyre was drawn<lb />out of her Guilford County<lb />majority-black district, and<lb />placed into a white major-<lb />ity district. - I<lb />Jenkins also reduced the<lb />percentage of black voters<lb />in. Rep. Dan Blue's<lb />majority-minority Wake<lb />County district to below 50<lb />percent, creating eight<lb />House districts that could<lb />lean more favorably to<lb />Republicans. Usala owns Ectocelle,<lb />a new cell regeneration<lb />research company based in<lb />Greenville. He also is a<lb />part-time professor at the<lb />Brody School of Medicine<lb /><lb />at East Carolina University .<lb /><lb />in pediatric endocrinology.<lb />"We think it's a great fit,"<lb />Usala said of his partner-<lb />ship with Utley.<lb /><lb />The golf classic proceeds<lb />also will benefit the re-<lb />search through the Mike<lb />Utley Foundation. Utley<lb />wants to fund research that<lb />will lead to functional im-<lb />provements in people with<lb />spinal cord injuries, He<lb />hopes someday to find a<lb />cure through research that<lb />leads to successful clinical<lb />trials in neural repair or<lb /><lb />regrowth giving him and<lb />others the ability walk and<lb />run again, he said.<lb /><lb />"The bottom line is to get<lb />appropriate research to find<lb />the cure for people with<lb />spinal injuries," Utley said.<lb />"We are looking for doctors<lb />and researchers wl » come<lb />together and work together<lb />for a cure for paralysis. We<lb /><lb />need to pull together."<lb />Utley, 36, is a native and<lb />resident of Washington<lb />state. Utley's love of sports<lb />landed him a college schol-<lb />arship and eventually<lb />launched him into a profes-<lb />sional football career.<lb /><lb />In 1989, he began his<lb />professional career for the<lb />Detroit Lions as a starting<lb /><lb />right guard. He suffered<lb />injuries in his first and<lb />second year before the<lb />career-ending injury in his<lb />third year. In addition, lawyers operating under<lb />the cover of  oeveryone deserves a fair trial ?<lb />bleed the perpetrators and their families un-<lb />til all'their money is gone and then advise<lb />to  ocop a plea ? to a reduced charge (Dis-<lb /><lb />trict Attorney General Bill Gibbons boasted<lb />a  ono plea-bargaining policy a couple of<lb />years ago. What ever happened to that?).<lb /><lb />The problem is about values and those<lb />entities in our society that teach and instill<lb />values aren Tt getting the job done. The<lb />parents, the churches and the  oprograms ?<lb />aren Tt getting the job done.<lb /><lb />City Councilman Myron Lowery has<lb />proposed raising the Crimestoppers re-<lb />ward from $1,000 to $5,000. While that<lb />will provide more incentive to turn these<lb />heathens in, stiffer penalties once they<lb />come to trial is the order of the day.<lb /><lb />The solution? The penalty for any first<lb />degree murder should be stiff. But when<lb />an individual (adult or juvenile) commits<lb />such a crime and a child is injured or<lb />killed, when that individual is apprehend-<lb />ed and convicted, the mandatory sentence<lb />should be a minimum of life in prison<lb />with no chance of parole  " no plea bar-<lb /><lb />- gaining  " no work release upon incarcer-<lb /><lb />ation  " just rot in jail!<lb /><lb />The people who built Alcatraz years ago<lb />had the right idea  " we need to learn<lb />from that.<lb /><lb />City school board<lb />makes the right move<lb /><lb />na long overdue move, the Mem-<lb />phis City School Board voted 8-1<lb /><lb />to mandate school uniforms in our<lb />city Ts public schools.<lb /><lb />While all the particulars have yet -<lb /><lb />to be worked out, the move will go a long<lb />way in helping restore the type of disci-<lb />pline many parents, students, teachers and<lb />school officials crave.<lb /><lb />Uniforms are not a cure-all for the many<lb />problems that are experienced in an urban<lb />school district but any barrier that is re-<lb />moved that will enhance focus on the pri-<lb />mary purpose of school attendance  " ed-<lb />ucation  " should be welcomed. Any other<lb />benefit is secondary and should be recog-<lb /><lb />nized as such.<lb /><lb />The lone dissenting board member,<lb />Hubon  Dutch T Sandridge, reportedly<lb />said that students dress is the responsi-<lb />bility is of the parent. That responsibili-<lb />ty, however, includes using good judg-<lb />ment relative to the environment in<lb />which children exist. It is apparent some<lb />parents don Tt internalize that responsi-<lb />bility appropriately.<lb /><lb />We are confident that as the specific<lb />guidelines are developed by our school<lb />board members they will take all factors<lb />into consideration with the result being<lb />policies that will enhance the educational<lb />environment for our future citizens.<lb /><lb />In scientist Ts vision, all<lb />Jefferson Ts progeny unite<lb /><lb />magine an endless, boundless<lb />dream filled with all God Ts people,<lb />a consciousness within which we<lb />know and understand everyone who<lb />has ever lived.<lb /><lb />It Ts the theory, one of ultimate brother-<lb />hood, by which rocket scientist Werner<lb />von Braun explains our destiny.<lb /><lb />Nothing in the universe, he said, can be<lb />destroyed. Webb<lb /><lb />s it a fact of life that perception is re-<lb /><lb />ality in the mind of the perceiver?<lb /><lb />The answer to this question is obvi-<lb /><lb />ously yes. The key however, is<lb /><lb />whether or not the perception is<lb />valid. Attitudes are developed based upon<lb />perceptions. When perceptions are based on<lb />misinformation or a lack of information the<lb />danger exists that attitudes will be formed<lb />void of rational justification.<lb /><lb />Because attitudes determine in large mea-<lb />sure the manner in which people interact, it is<lb />important that perceptions be based on expe-<lb />riential discovery. In a segregated society,<lb />positive interaction does not result as a natur-<lb />al byproduct of the interaction itself but must<lb />rather be consciously developed  " often in<lb />spite of preconceived attitudes.<lb /><lb />The Attitudinal divide<lb /><lb />Inherent in the evolution of attitudes of<lb />separate groups of people who have little<lb />contact with one another are stereotypical de-<lb />finitions of each group by the other. A White<lb />individual need not be an aggressive racist in<lb />order to be victimized by stereotypical think-<lb />ing which can result in bigotry toward<lb />African Americans. Similarly. an African<lb />American need not he personally or overtly<lb />victimized by bigotry in order to form a<lb />stereotypical distrust of all Whites.<lb /><lb />Whether segregation is imposed or whether<lb />it is circumstantial, the inevitable stereotypi-<lb />cal attitudes that result begets discrimination.<lb />In a segregated society many Whites T experi-<lb />ence only minimal exposure to African<lb />Americans except through the media. If<lb />African Americans are stereotypically por-<lb />trayed as criminals. vagrants or welfare<lb />abv-ers in newspapers. on television and in<lb />the heaters it is easy to understand that many<lb />Whites will place  oall ? African Americans in<lb />those categories.<lb /><lb />It is also understandable that as socio-eco-<lb />nomic class definitions become more evident<lb />within the African-American community,<lb />many middle class African Americans will<lb />form a similar stereotypical attitude about<lb />poor and inner-city African Americans. One<lb />contemporary phenomena that fosters this at-<lb />titudinal divide is the radio talk shows that<lb /><lb />play the demagogue role and help to perpetu-<lb />ate stereotypes of all kinds.<lb /><lb />When school desegregation began, many<lb />White families whose economic circum-<lb />stances allowed them to provide their children<lb />with excellent pre-school advantages or who<lb />could at a minimum relocate to areas outside<lb />the city limits, withdrew their children from<lb />the city public schools. This pattern continued<lb />until African-American children constituted<lb />the overwhelming public school population<lb />majority. Many of these children lived in<lb />poverty and had extremely limited pre-school<lb />exposures. The result was that overall<lb />achievement test score averages dropped.<lb /><lb />Many White citizens and some African<lb />Americans as well, formed the opinion (and<lb />media has not seen fit to editorially address<lb />this with any degree of consistency) that city<lb />public schools (i.e. African-American<lb />schools) headed by what is now a majority<lb />African-American school board, three succes-<lb />sive African-American superintendents and<lb />other African-American administrators were<lb />and are woefully inadequate. The fact of the<lb />matter is that the  opoor ? scores were always<lb />there. They were simply  ohidden ? by the<lb />scores of those students (many of whom hap-<lb />pened to be White) who had the economic<lb />(not intellectual) advantages of positive pre-<lb />school and away from school exposures.<lb /><lb />Today, if African-American families whose<lb />circumstances lend to positive pre-school and<lb />positive away from school exposures were to<lb />withdraw their children leaving only the chil-<lb />dren of poor families in our city public<lb />schools, we would witness an even greater<lb />drop in overall test score averages.<lb /><lb />Another attitudinal phenomena that results<lb />from segregation is that many Whites who do<lb />interact with African Americans in the work-<lb />place often view those African Americans as<lb />being  odifferent ? . A parallel example of this is<lb />the attitude of earlier years in instances where<lb />White families who viewed their African-<lb />American maid or nanny as  oalmost like a<lb />member of the family ? while being totally un-<lb />comfortable in the company of other African<lb />Americans whom they normally had little con-<lb />tact.<lb /><lb />(Webb, is a nationally recognized historian<lb />and a staff writer for the Tri-State Defender)<lb /><lb />by Michael King<lb /><lb />or fans of science fiction and<lb />mysteries like me, the acronym<lb />TANSTAAFL means a lot. It<lb />refers to the notion that if some-<lb />thing is too easy it is either too<lb />good to be true or has much larger and<lb />harsher consequences down the road.<lb />When it comes to the reparations debate,<lb />Black America needs to learn about<lb />TANSTAAFL.  oThere Ain Tt No Such  T<lb />Thing As A Free Lunch. ? Many of us be-<lb />lieve the government  oowes ? us reparations<lb />for the years of slavery in the United States<lb />and British Crown Colonies. Members of<lb />the so-called  Black elite T such as former<lb />TransAfrica head Russell Robinson and<lb />Congressman, D-Mich., hold that view.<lb />Robinson authored The Debt: What Ameri-<lb />ca Owes To Blacks in which he lays out his<lb />case for government reparations for Black<lb />Americans. Conyers repeatedly introduces<lb /> legislation for reparations payments to the de-<lb />scendants of slaves in the United States.<lb />Robinson and Conyers hang their hat on<lb />the concept of  o40 acres and a mule. ? It Ts<lb />the failed Reconstruction idea to give freed<lb />slaves 40 acres of farmland and a mule to<lb />Plow it. This notion, championed by Gen.<lb />illiam Sherman after the Civil War, was<lb />vetoed more than once by President An-<lb />drew Johnson. The misconception of a<lb />government promise to provide land and<lb />abor to emancipated slaves persists today.<lb />On talk shows from coast to coast, peo-<lb />ple sell the sizzle of a payment in the form<lb />of land, money or both. Hucksters set up<lb />scams, promising to create a massive class<lb />action lawsuit to force the government to<lb /> oenforce their own promise. ? You must,<lb />however, pay them ives in advance  oto<lb />help defray legal cos:s. ? Others claim to<lb />offer reparations payniwiis if the quilible<lb />imply provide ines vredil Cure GunwelD.<lb />people poli oct tie Jallwctes relate<lb /><lb />+ fing to the wep pation, dooete, aud they are<lb /><lb />Slavery reparations<lb />aren't a  free lunch T<lb /><lb />Black themselves, they are derided as sell-<lb />outs,  oUncle Toms, ?  oOreos ? and far worse<lb />names. They are told they have forgotten<lb />who they are and that they are helping the<lb /> oWhite devils ? keep the Black man down.<lb />But these people seek to point out rational<lb />and reasonable truths: there are no living<lb />slaves left. If the government gave money to<lb />every descendant of every slave, the govern-<lb />ment would quickly go bankrupt. Finally, if<lb />the government were to make payments,<lb />how could the government determine exactly<lb />who descended from slaves and who de-<lb />scended from free Blacks in the North, free<lb />citizens from other countries or whose ances-<lb />tors immigrated after slavery was abolished?<lb />In the rare instances where reparations<lb />were paid te-ethnic groups for past injustices,<lb />they were paid to the individuals to whom the<lb />injustices were inflicted or immediate family.<lb />I know there isn Tt a single slave and probably<lb />no immediate family member left alive to re-<lb />ceive government reparations from when<lb />slavery was legal for less than 100 years.<lb />That Ts right. Slavery was legal in the<lb />United States for only 89 years. It may not<lb />have been right in the eyes of God, but it<lb />was right and legal in the eyes of the law of<lb />the era. Should the government apologize<lb />for slavery? Yes and no. Yes, apologize for<lb />the wrongful treatment of the countless<lb />Blacks enslaved in this country. However,<lb />no apology is necessary for the fact that, at<lb />the time, it was legal. You don Tt see the<lb />government apologizing for not granting<lb />women the right'to vote prior to 1920.<lb />All | want people to do is think rationally and<lb />get from the emotionalism that the so-<lb />called leaders are using to rabble-rouse us.<lb />Trying to fon push and bleckmall the<lb />government into paying out what amounts<lb />to a wi lottery check to Black Ameri-<lb />cans is more than trying to ont<lb />something for nothing.           <lb />eres<lb /><lb />clusions as<lb /><lb />down<lb /><lb />Tougher on Crime<lb /><lb />PHILADELPHIA -- Ten<lb />Black male judges in<lb />four Pennsylvania<lb /><lb />counties from 1991 to<lb /><lb />1994 were more likely<lb />to mete out jail time<lb />than those handed<lb />down by 80 White coun-<lb /><lb /> terparts in the same<lb /><lb />counties during the<lb />same period, a recent<lb />study found.<lb /><lb />Authored by Darreil<lb />Steffensmeier a pro-<lb />fessor at Penn State<lb />University and<lb />Chester L. Britt, of<lb />the Arizona State<lb />University, the study<lb />was an attempt to as-<lb />sess the role of a<lb />judge _s race on sen-<lb /><lb />tencing in criminal<lb />cases.<lb /><lb />The report titled<lb />"Judges _ Race and<lb />Judicial Decision<lb />Making: Do Black<lb />Judges Sentence<lb />Differenrly?" was<lb /><lb />initially published<lb />in the Decémber 2001<lb />issue of Social<lb />Science Quarterly.<lb />When its results were<lb /><lb /> publicized in<lb /><lb />Philadelphia in re-<lb />cent days, it became<lb />an important topic<lb />for discussion.<lb />Though short on con-<lb />to why<lb />Black judges handed<lb />harsher  sen-<lb />tences on average<lb />than their White<lb />counterparts, the<lb />study seemed to sug-<lb />gest background, not<lb />race is more of a fac-<lb />tor ina judge _s deci-<lb />sion. A Black judge<lb />who wished to remain<lb />anonymous commented<lb />as much in the study.<lb />"Really, as far as<lb />toughness, the Black<lb />judges I know are as<lb /><lb />x<lb /><lb />tough or tougher than<lb /><lb />White judges," the<lb />judge said. "They<lb />(Black judges) know -<lb /><lb />in a personal way how<lb />crime affects the<lb />lives of people and<lb />will feel in a per-<lb />sonal way the need to<lb />do something about<lb />it."<lb /><lb />Researchers looked at<lb /><lb />records from<lb />Philadelphia,<lb />Allegheny, Dauphin<lb /><lb />and Lawrence counties<lb />where the only Black<lb />judges in the state<lb />were located at the<lb />time of the inquiry.<lb />Pennsylvania was cho-<lb />sen for the study be-<lb />cause its judges are<lb />allowed more sentenc-<lb />ing discretion than<lb />judicial systems with<lb />similar guideline<lb />structures, the re-<lb />searchers said. The<lb />discretion could al-<lb />low a higher likeli-<lb />hood of sentencing<lb />disparity from judge<lb />to judge.<lb /><lb />The study looked at<lb />more than 38,500 sen-<lb />tences decided by the<lb />90 judges. Although<lb />the White judges were<lb />more likely to give<lb />longer prison sen-<lb />tences, the differ-<lb />ence on average was<lb />about a month, the<lb />study found.<lb /><lb />Of more interest was<lb /><lb />the finding that<lb />Black judges were 12<lb />percent more likely<lb />to sentence offenders<lb />to prison and six per-<lb />cent more likely to<lb />jail drug offenders,<lb />the study said.<lb />Robert Muhammad, a<lb />long time defense at-<lb />torney in the city,<lb />told The Final Call<lb />the study did not sur-<lb />prise him.<lb /><lb />"TI think the Black<lb />judges are probably<lb /><lb />. ufider tougher<lb /> o tiny,"he said. "They<lb /><lb />scru-<lb /><lb />have to show they are<lb />willing and able to<lb />give out the type of<lb />punishment that<lb />their administrators<lb />or supervisors or the<lb />public really wants<lb />them to give out."<lb />But, he added, "You<lb />need to look at the<lb />cause of something<lb />and then look at its<lb />root cause if you<lb />really are sincere<lb />about solving the<lb />problem."<lb /><lb />"When many of these<lb />judges make the<lb />statement they have<lb />been personally af-<lb />fected, I say, and so<lb /><lb />what? That means<lb />there 1s even a<lb />greater demand on<lb /><lb />their part to deal<lb />with the cause, as<lb />well as the problem,"<lb />he said.<lb /><lb />The Barristers<lb />Association and the<lb />Pennsylvania Bar<lb />Association would<lb />not provide comment,<lb />saying they were not<lb />familiar with study.<lb /><lb />Attorney Leon<lb />Williams, a recent<lb />candidate for<lb />Philadeiphia dis-<lb />trict attorney,<lb />doubted there was<lb /><lb />much to the study.<lb />"T haven_t seen Black<lb />judges being<lb /><lb />tougher. I have seen<lb />some Black judges who<lb />have felt, just like<lb />Black cops, who like<lb />to show White people<lb />how tough they are<lb />with Black people. He says<lb />that today, more than<lb />ever, we are in need<lb />of dedicated people<lb />to get involved with<lb />all decisions being<lb />made about the com-<lb />munities in which we<lb />live. According to the<lb />Supreme Court. the entire<lb />household is at fault.<lb />Recently the court backed<lb />rules that permit evictions of<lb />families of federally subsi-<lb />dized housing if any family<lb />member or guest is involved<lb />in drugs. Public housing<lb />directors can evict entire<lb />families for drug, use by one<lb />member, regardless  " of<lb />whether the use was on<lb />public housing property ot<lb />if anyone else knew about it.<lb />Should grandma and baby<lb />Jane be forced to find a new<lb />place to live because of the<lb />Knucklehead who sleeps in<lb />the same house T<lb /><lb />The court has endorsed a<lb />rule that) further divides<lb />those who live in- public<lb />housing trom the general<lb />poptlation. The rules are<lb />different because the rest-<lb />dents are receiving govern-<lb />ment assistance. Their<lb /><lb />rights to live in decent<lb />housing are pulled from<lb />underneath them if a person<lb />has used drugs. What<lb />would it look like if we<lb />applied that same principle<lb />to persons not living in<lb />public housing? Couldn Tt it<lb />be argued that a family<lb />should be evicted when a<lb />person in the household gets<lb />stopped for a DWI? Why<lb />not? Shouldn Tt we blame<lb />everyone in the house?<lb />People in public housing<lb />don Tt get the benefit of the<lb />doubt. Since the home<lb />environment was such that a<lb />person in the home used<lb />drugs. the entire household<lb />will be punished.<lb /><lb />The court ruling follows a<lb />new trend in the way people<lb />look at the substance abuse<lb />problem. It has long been<lb />understood that drug addic-<lb />tion is a disease. Despite<lb />the research to justify the<lb />need for more substance<lb />abuse treatment facilities,<lb />the few services offered to<lb />addicts are being closed.<lb />Insurance companies are<lb />making it harder for people<lb />to get treatment for addic-<lb />tions. Those who are ad-<lb />dicted and in search of a<lb />way to change their lives are<lb />finding it harder to locate a<lb />place to get help. Now the<lb />court has taken things to<lb />another level. Not only do<lb />we refuse to help you with<lb />your problem, we're going<lb />to punish you and your<lb />family because of you. The<lb />opinion of the court failed<lb />to take into account the<lb />nature of addiction and the<lb />impact the disease has on<lb /><lb />the entire family. Four<lb />California senior citizens<lb />received eviction notices<lb />because of drug use by<lb />relatives or caregivers. The<lb />court ruled in favor of the<lb />decision to kick grandma<lb />out because of the habit of<lb />another person. The sad-<lb />dest thing is the senior<lb />citizens didn Tt know about<lb />the drug use.<lb /><lb />There is a double standard<lb />in the way we deal with the<lb />poor. The issue of sub-<lb />stance abuse touches all of<lb />us. The bad news is we<lb />think differently about the<lb />way to approach the issues<lb />based on the income of the<lb />persons involved. Last<lb />year, President Bush's un-<lb />derage daughters were<lb />caught trying to buy alcohol<lb />(which is also a drug) in a<lb />Texas restaurant, and his<lb />niece, the daughter of<lb />Florida Governor Jeb Bush,<lb />was admitted to a drug<lb />treatment center in February<lb />after being arrested on a<lb />prescription charge. Most<lb />would agree that their prob-<lb />lems are not to be blamed<lb />on he president or Jeb Bush.<lb />It would be foolish to assert<lb />that the president should<lb />vacate the White House.<lb />We can Tt hold him responsi-<lb />ble for what happens under<lb />his nose. He never<lb />identified himself by name.<lb />But his self-description as<lb /> othe son of David, King in<lb />Jerusalem, ? as well as his<lb />comments about wealth,<lb />power, wisdom, great<lb />achievements, and many<lb />wives, point to King<lb />Solomon (see 1:1,12,16;2:4-<lb />9; 7:26-29;12:9). If we<lb />accept Solomon as_ the<lb />author, then we see in<lb />Ecclesiastes glimpses of the<lb />dramatic story of a king<lb />who began his reign well<lb />but then lost sight of what Ts<lb />most important in life (1 Ki.<lb />11:1-13). In his latter years<lb />he reviewed how he had<lb />spent his days. As he<lb />grew older, he tried to fill<lb />that ache for something<lb />more by seeking answers<lb />from the gods of the nations<lb />around him (1 Ki, 11:1-13).<lb />All his knowledge, though,<lb />could not fill the emptiness<lb />he felt. With most chil-<lb />dren now arriving at an<lb />empty house afterschool.<lb />does late-aftemoon televi-<lb />sion fare matter? Does it<lb />matter if, instead of leaving<lb />our children to Beaver, we<lb />leave them to Beavis? Does<lb />viewing primetime  influ-<lb />ence their thinking and act-<lb />ing? Does the media mold<lb />us? Mirror us? Or both?<lb />By the end of elementary<lb />school, the average child<lb />views some 8,000 TV mur-<lb />ders and 1.900.000 other<lb />violent acts. In the enter-<lb />tainment world, implied<lb /><lb />acts of sexual intercourse<lb /><lb />over-whelmingly occur be-<lb /><lb />tween unmarried people.
