          <lb />High court ruling may<lb /><lb />hurt minorities, women<lb /><lb />by: Isabelle K. Pinzler<lb /><lb />Last week the Supreme Court,<lb />in one of its by-now-routine 5-4<lb />votes, announced an ominous<lb />but little understood decision in<lb />Alexander v. Sandoval.<lb /><lb />Its history and the process by<lb />which this case got to the court,<lb />its actual holding, as well as its<lb />obviously intended implications,<lb />are throughly chilling, not only<lb />to the rights of minorities, its<lb />immediate subject, but to all<lb />women as well.<lb /><lb />The case involved a challenge<lb />by a Hispanic woman, Martha<lb />Sandoval, to a new requirement<lb />by the state of Alabama that<lb />drivers license tests can be taken<lb />only in English. She argued,<lb />inder well-established law and<lb />precedent, that the rule, whether<lb />intentionally or not, has a dis-<lb />criminatory effect on her and<lb />keeps her from getting a drivers<lb />license because of her national<lb />origin. James Alexander, direc-<lb />tor of Alabama's Dept. of Public<lb />Safety, was named as a defen-<lb />dant.<lb /><lb />That both the federal trial and<lb />appellate courts agreed with her<lb />was not suprising since the<lb />principles she invoked had been<lb />recognized by the Supreme<lb />Court since the mid-1970s and<lb />repeatedly ratified by the<lb />Congress since then.<lb /><lb />What was shocking was the<lb /><lb />www -tehaot thatthe current high court<lb /><lb />took ghe case at all, and then it<lb />agreed with Alabama, a state<lb />that has an extensive record of<lb />. resisting the rights of minorities,<lb />to limit the scope of a vitally<lb />important civil rights protection.<lb />It was the second time this term<lb />that the court entertained a<lb /><lb />Educator<lb /><lb />x<lb /><lb />&amp; 4<lb /><lb />Ms Frucis Melons<lb /><lb />This letter was recently ac-<lb />quired by the M' Voice staff and<lb />we thought it bears reporting.<lb />We also, in printing this letter,<lb />acknowledge the leadership and<lb />inspiration of Mr. Francis<lb />Mebane.<lb /><lb />eee<lb /><lb />" 7<lb />AY, ges oes<lb />4<lb /><lb />of life.<lb /><lb />Serving Eastern North Carolina Since 1981<lb /><lb />What You See Is What You Get; What You Read Is What You Know And Save<lb /><lb />challenge by Alabama to a<lb />previously well-established civil<lb />rights protection. The other case<lb />involved the Americans with<lb />Disabilities Act.<lb /><lb />Sandoval brought her case<lb />under Title VI of the Civil<lb />Rights Act of 1964. Title VI<lb />prohibits of federal financial<lb />assistance, and Alabama, like<lb />every other state, receives large<lb />infusions of federal transporta-<lb />tion money. In exchange for that<lb />bid, they are supposed to refrain<lb />from discrimination.<lb /><lb />Supposedly impartial practices<lb />can have discriminatory impact.<lb />But many supposedly impartial<lb />practices have a tremendously<lb />discriminatory impact on racial<lb />and ethnic minorities, as well as<lb />women, girls, and other pro-<lb />tected groups. Example include<lb />racial profiling by police, plac-<lb />ing potentially toxic plants or<lb />waste treatment facilities in mi-<lb />nority neighborhoods, height<lb />and weight requirements for<lb />employment and other selection<lb />procedures, such as written tests,<lb />and so on.<lb /><lb />Intentional discrimination, on<lb />the other hand, may be difficult<lb />to prove, even where it exists.<lb />That the intent may have been<lb />benign does not soften the harsh<lb />effects. Thus, 30 years ago, a<lb />unanimous Supreme Court led<lb />by Warren Burger, the conserva-<lb />tive chief, rot the liberal Earl<lb />Warren, roundly condemned un-<lb />intentional discrimination~ that<lb />nevertheless harmed minorities,<lb />characterizing it as a "built-in<lb />headwind."<lb /><lb />Yet the current court, by a bare<lb />majority, has seen fit to limit<lb />access to federal courts to a<lb />challenge this kind of systemic<lb />discrimination when committed<lb />with the use of federal funds.<lb /><lb />Mentor<lb /><lb />A recent conversa-<lb />tion with one of our<lb />employees brought to<lb />my attention how<lb />deeply indebted we<lb />are to you and your<lb />school for the re-<lb />markable number of<lb />talented young men<lb />produced by your lo-<lb />cal school who are<lb />now working for us.<lb /><lb />Mr. Willie Langley,<lb />a graduate of your<lb /><lb />class of 1960, is pres-<lb />ently one of our most<lb />accomplished __ line-<lb />men, and more im-<lb />portantly, one of the<lb />finer people in our organization.<lb />Mr. Langley has been a leader in<lb />encouraging others of race to<lb />seek employment with this end<lb />other companies, and to exert<lb />themselves to achieve the maxi-<lb />mum of their capability.<lb /><lb />Among the former students of<lb />your school who are presently<lb />employed with The Connecticut<lb />Light and Power Company in<lb /><lb />Voting against Sandoval were<lb />Chief Justice William H.<lb />Rehnquist and Justices Anthony<lb />M. Kennedy, Sandra Day<lb />O'Connor, Antonin Scalia and<lb />Clarence Thomas.<lb /><lb />The Sandoval decision will, in<lb />all likelihood, apply with equal<lb />force to similar provisions of<lb />Title IX of the Education<lb />Amendment of 1972 that prohib-<lb />its discrimination on the basis.of<lb />sex in federally-assisted educa-<lb />tion programs. Similarly, the<lb />decision also can be expected to<lb />apply to Section. 504 of the<lb />Rehabilitation Act of 1974 and<lb />Title Il of the Americans With<lb />Disabilities Act, which prohibit<lb />discrimination on the basis of<lb />disability in federally funded<lb />programs.<lb /><lb />Biased educational practices<lb />could be exempt from challenge.<lb />For women and girls, this means<lb />that educational practices such<lb />as standardized tests, which have<lb />a discriminatory effect on<lb />women, that is, disparate impact,<lb />are likely to become exempt<lb />from an individual challenge<lb />under Title IX. It is known fact,<lb />for example, that women tend to<lb />score lower than men on the<lb />SAT, despite the fact that women<lb />tend to get higher grades in<lb />college, which is what the<lb />aptitude test is supposed to<lb />predict.<lb /><lb />The result is that women must<lb />get higher grades in high school<lb />to gainTan equal shot at admis-<lb />sion to the same colleges as<lb />higher-scoring men, and_ they<lb />may lose out on numerous<lb />scholarship opportunities in<lb />which standardized tests are a<lb />deciding factor.<lb /><lb />Even more worrisome is the<lb />fact that the same ultra-<lb /><lb />Role Model<lb /><lb />Norwalk, Conn., are Charlie M.<lb />Weaver, Jr., class of 1965, Johnny<lb />R. That<lb />would be great tragedy.<lb /><lb />We are long past the time when<lb />anyone is foolish enough to put<lb />out a sign saying "No Blacks<lb />need apply" or print. separate<lb />columns for "help-wanted----<lb />male" and "help-wanted----<lb />female," but the results are still<lb />all too often the same.<lb /><lb />All women, minority men and<lb />women, and the disabled of both -<lb />genders and many races have<lb />made great progress in the last<lb />40 years.<lb /><lb />But if recent developments in<lb />the courts have been any indica-<lb />tion, nothing, not even long-<lb />entrenched legal precedents, is<lb />set in tone. So,<lb />imagine the glee that Robert L.<lb />Brock, a 76-year-old legal activ-<lb />ist, felt when writers from main-<lb />stream newspapers like the<lb />Boston Globe and Washington<lb />Post approached him for inter-<lb />views and information about his<lb />long history pursuing repara-<lb />tions for Blacks.<lb /><lb />Polls in 1995 showed less<lb />than 10% of African Americans<lb />Supporting the concept of repa-<lb />rations. Against this back drop<lb />of swimming against the tide,<lb />Brock toiled 40 years toward<lb />getting Blacks compensation for<lb />the "40 acres and a mule" they<lb />should have gotten at the end of<lb />slavery. He has filed numerous<lb />class-action suits for Blacks to<lb /><lb />ain compensation for slavery,<lb />including Dec.10, 1965, suit that<lb />preserved the rights of Blacks to<lb />sue against the statues of the<lb />13th Amendment. "You couldn't<lb />mary if not for high ames<lb /><lb />rock regarding high-powe<lb />lawyers, including Harvard Law<lb />pe essor Charles Ogeltree and<lb />ohnnie Cochran, who. have<lb />been plotting strategy for a<lb />class-action lawsuit seeking<lb />reparations,<lb /><lb />With the high-profile of<lb />Randall Robinson and lawyers<lb />Ogeltree and Cochran, main-<lb />stream media such as CBS, the<lb />Post and the Globe have been<lb /><lb />Ashlee L. Daniels recently partici-<lb />pated in the "2001 Gold &amp; White<lb />Cotillion" sponsored by the North<lb /><lb />Carolina State Grand Assembly<lb />Order of The Golden<lb />Circle, AASR-P.H.A.<lb /><lb />T The biannual event was held in<lb />Charlotte, NC with the theme being<lb />"Presenting the Guardians of<lb />Tomorrow". A growing number of<lb />reparations proponents have pro-<lb />pelled Detroit Congressman<lb />John ConyersT bill---H.R. 40---<lb />to the forefront in the US House<lb />of Representatives.<lb /><lb />But instead of getting the .<lb /><lb />issue to the Supreme Court,<lb />where Brock wants it heard,<lb />acknowledgment of the repara-<lb />tions issue by the majority media<lb />has simply reaped scorn on<lb />Brock.<lb /><lb />"Why are they attacking<lb />me?", asks Brock. "Hell, | am<lb />the one who got Conyers started<lb />on the bill." Correspondence<lb />records do show that Brock's<lb />early 1980s discussions of repa-<lb />rations with former California<lb />Congressman Agustus Hawkins<lb />and Mervyn Dymally prompted<lb />them to publicily announce their<lb />support for reparations and for<lb />Brock to share his findings with<lb />the executive director of the<lb />Congressional Black Caucus.<lb />From those CBC discussions<lb />came the reparations bill that<lb />Conyers has introduced annually<lb />in Congress since 1989,<lb />"Conyers doesn't give me credit<lb />for starting the issue, but that<lb />really isn't important" Brock<lb />says. However, he does get<lb />credit in the American<lb />Association Journal's story on<lb />reparations in their Nov. 2000<lb /><lb />\<lb /><lb />daughter of Rev. &amp; Mrs. James and<lb />Fannie W. Jackson, the newspaper said, in-<lb />sists that he and Stanford are not at odds. Sharpton did not<lb />pull JacksonTs coat. oI am nearly as upset with Al Sharpton<lb />as I am with you,� Walker told Jackson in his letter.<lb /><lb />The aide explains that Sharpton was caught between two<lb />mentors. oOn the one hand, Walker is the chairman of his<lb />board,� the aide points out. oHe wants to be respectful of<lb />Walker. wo<lb /><lb />oOn the other hand, Sharpton was a student of Jackson<lb />and at the time the media was speculating that Sharpton<lb />would be the heir to Jackson. He did not tell Jackson what<lb />Walker said because he did not want Jackson to believe he<lb />was trying to take advantage of his vulnerability.�<lb /><lb />Jackson " avoiding any mention of his affair"told the<lb />more than 300 people who packed the church that the most<lb />important issue since the presidential election was voter ac-<lb />cess, the right to vote, and the right to be counted.<lb /><lb />oHe did not repent,� the Sharpton aide laments. oHe did<lb />not apologize. He made a political speech. He never re-<lb />ferred, even remotely, to the scandal.� <lb /><lb />Walker was outraged. Ten days later, after watching a<lb />videotape of JacksonTs appearance, he demanded a meeting<lb />with Sharpton. The preachers argued bitterly. After Sharp-<lb />ton repeatedly explained to Walker how WalkerTs directive<lb />had put him in oa bind,� Walker relaxed his criticism of<lb />Sharpton, but he remained angry at Jackson for reneging on<lb />their agreement.<lb /><lb />As WalkerTs congregation and his ministerial colleagues<lb />pressured him about the apology that wasnTt, Walker told<lb />Sharpton that he planned to write a letter of reprimand to<lb />Jackson.<lb /><lb />Jackson learned of WalkerTs intentions and allegedly tried<lb />to stop the letter. According to a Sharpton aide, Jackson<lb />obrowbeat� Sharpton into pleading with Walker. oJackson<lb />knew that a letter from Martin Luther KingTs former chief<lb />of staff would devastate him if it got into the wrong hands,�<lb />says a political operative who attended the vigil.<lb /><lb />Walker wrote the letter anyway and sent it to Jackson. In<lb />the following excerpt, Walker scolds Jackson.<lb /><lb />oYou disrespected me, my pulpit and my people,� Walk-<lb />er wrote. oI had to publicly apologize to my congregation<lb />on Sunday for my poor judgement in allowing that kind of<lb />rally to be held in the sanctuary in my absence. I promised<lb /><lb />' them. it-would neVer happen again.as long as I am pastor...<lb /><lb />I relented when Al reported to me that Judith Price suggest-<lb />ed that once the service began, the media could take pic-<lb />tures without audio and then be excused. Instead, it became<lb />a circus with photographers standing on the pews in our<lb />sanctuary. The live broadcast reinforced the image in the<lb />general community that people of African ancestry have lit-<lb />tle sense of morality.<lb /><lb />oHow crass of Charlie Rangel, in light of your fathering<lb />a child outside of your marriage, declaring again and again<lb />from my pulpit; Get over it!� My personal credibility and<lb />that of my church has been terribly scarred by all that tran-<lb />spired last Tuesday as a prelude to your Wall Street Project.<lb />You have created so much pain for all clergy persons...<lb /><lb />oThe bottom line is that you cannot help yourself. Your<lb />addiction to the need of media attention seems to be fatal<lb />and you have fallen into the practice of using people for<lb />your advantage and personal aggrandizement. For example,<lb />with all the risk of allowing you to come to Canaan, you<lb />have not even had enough grace to call and thank us for<lb />opening our doors to your questionable purposes. I nixed<lb />the choir business and you arrive with the so-called Soul<lb />Stirrers, who sing for forty minutes in violation of what was<lb />agreed upon. I suppose I should not be surprised since the<lb />only time I have heard from you in the last ten years is when<lb />you wanted something.�<lb /><lb />After reading the letter, Jackson reportedly called Sh<lb />ton. An aide says Jackson cautioned Sharpton that certain<lb />forces would try to play them against each other. In fact,<lb />some of those forces were inside SharptonTs own National<lb /><lb />_ Action Network.<lb /><lb />Anti-Jacksonites begart to urge Sharpton to shun hisT<lb />oself-destructing" friend, sontinue to build<lb /><lb />on his gains in the national civil rights arena, and focus<lb />attention on deciding whether to run for mayor.<lb />Walker's damaging letter, according to Jackson insiders,<lb />has hurt Jackson's image among prominent Black<lb />clergy, who have called on him in the past to mediate<lb />racial strife in their cities,<lb /><lb />But the biggest political blow to Jackson was the<lb />out-right rejection of his offer to go to Cincinnati to try<lb />to end four days of rioting over the April 7 shooting of<lb />Timothy Thomas, an unarmed Black teenager, by a<lb /><lb />' white policeman.<lb /><lb />The slaying sparked the city's worst outburst of racial<lb />violence since the aftermath of the assasination of:<lb />Martin Luther King in 1968. The lottery is not about<lb />North Carolina being one of the<lb />38 states who have a lottery or<lb />the 12 that don't. It's not about a<lb />poor tax or moral convictions,<lb />because less we forget, the<lb />lottery is a voluntary venture.<lb /><lb />Those North Carolinians who<lb />play the lottery in Virginia,<lb />Georgia, and else where (and<lb />soon to be South Carolina) are<lb />mature adults who have made a<lb />decision as to how they will<lb />invest their PERSONAL money.<lb />This money they're spending on<lb />the lottery does not (by default)<lb />belong to the businessman in the<lb />area. Our Northern Counties<lb />along the Virginia border haven't<lb />experienced any increase in<lb />crime associated with their play<lb />of the Virginia lottery. Churches,<lb />Mosque, Temples and<lb />Synagogues haven't experienced<lb />any lose of membership or<lb />patronage because their citizen-<lb />ship plays the lottery ever now<lb />and then. So what's the problem?<lb />I'll tell you what the problem is.<lb />It's a group of North Carolinians<lb />(some of whom I highly respect)<lb />who've decided to follow the<lb />leadership of Chuck Neely and<lb />oppose a State Lottery on so<lb />called moral grounds. What<lb />bothers me is that these anti<lb />lottery voices aren't raising a<lb /><lb />| WhoT s Lottery i is it anyway<lb /><lb />finger to do anything about the<lb />$300,000,000.00. North<lb />Carolinians spent in Virginia last<lb />year (the Governor could have<lb /><lb />really used that money in North "<lb /><lb />Carolina this year). It appears to<lb />me that the anti lottery folks are<lb />saying.... "We don't care if North<lb />Carolinians spent every dime on<lb />the lotteries of Virginia,<lb />Tennessee, Georgia and South<lb />Carolina. We don't care if we<lb />don't have the funds we need to<lb />improve education in North<lb />Carolina; we just want to be able<lb />to say, in the final analysis, that<lb />North Carolina didn't have a<lb />state supported lottery."<lb /><lb />You've gotta wonder if these<lb />guys have both oars in the water:<lb />They've gotta know that educa-<lb />tion is the bedrock of any<lb />community or society. " Don't just say<lb />no to the lottery, tell us your plan<lb />to provide for smaller class-<lb />rooms, increased teacher sala-<lb />ries, quicker access to at-risk<lb />children and higher education<lb />opportunities for the historically<lb />disadvantaged of our great<lb />state".           <lb />City Council passes redistricting<lb /><lb />City Council passes redis-<lb />tricting plan, seeks map<lb />approval<lb /><lb />by: T. Scott Batchelor<lb />Daily Reflector<lb /><lb />The Greenville City Council<lb />on Tuesday unanimously passes<lb />a redistricting plan for municipal<lb />elections and asked federal offi-<lb />cials for quick approval of the<lb />new map. Large population<lb />shifts revealed by the 2000<lb />census in two of the five Council<lb />districts triggered the need for<lb />redistricting.<lb /><lb />Mildred Council's District<lb />One, the least populous with<lb />8,180 people, was nearly 33%<lb />below the ideal number of<lb />roughly 12,200 people. The<lb />largest, District 5, represented<lb />by Arielle Morris, had nearly<lb />58% more people than the target<lb />figure.<lb /><lb />The council voted to approve<lb />the changes after a public hear-<lb />ing that drew comments from<lb />one resident. South Carolina<lb />consultant Bobby Bowers re-<lb />drew the districts. Residents got<lb />a chance to pursue the changes<lb />during three informational meet-<lb />ings last week.<lb /><lb />The redistricting must be<lb />approved by the US Department<lb />of Justice to ensure that the new<lb />plan doesn't dilute the voting<lb /><lb />Your hrain sands<lb />billions<lb />of mcssag<lb /><lb />to your body every secon<lb /><lb />power of blacks. Federal officials<lb />have 60 days to review the<lb />document, but that time can be<lb />extended if the department re-<lb />quests more information.<lb /><lb />In order to hold the municipal<lb />election scheduled for ov. 06,<lb />City Attorney Dave Holec said<lb />the redistricting plan needs<lb />Justice Department approval by<lb />July 18, three business days<lb />before candidates begin filing<lb />for office on July 23.<lb /><lb />As a Safety net, the council<lb />has voted unanimously to post-<lb />pone the Nov.06 election until<lb />May 07, 2002, if approval is not<lb />received in time.<lb /><lb />Don Cavellini was the sole<lb />speaker during Tuesday's public<lb />hearing. He asked if communi-<lb />ties could have been spared<lb />from being split in the redistrict-<lb />ing plan.<lb /><lb />Bowers said that would be :<lb /><lb />impossible because the redrawn<lb />lines follow federally mandated<lb />census blocks, which do not take<lb /><lb />ee<lb /><lb />into account whether the area is<lb />an established community.<lb /><lb />In general, federal law<lb />requires redistricting if the over-<lb />all deviation from the number in<lb />the most populous district and<lb />the least populous districts com-<lb />bined is more than 10%, Holec<lb />said.<lb /><lb />_ The cumulative deviation<lb />between districts 1 &amp; 5 was<lb />nearly 90%.<lb /><lb />The redistricting plan submit-<lb />ted by Bowers drops that devia-<lb />tion to less than 8% and<lb />maintains the percentage of mi-<lb />nority voters in districts 1 &amp; 2.<lb /><lb />Mayor Nancy Jenkins and<lb />Councilman Chuck Autry are<lb />unaffected by the changes be-<lb />cause they are elected at-large.<lb /><lb />Autry asked if everyone was<lb />happy with the changes.<lb /><lb />"I'm not sure that I'm happy,"<lb />Council said. Pinzler<lb /><lb />Last week the Supreme Court, in<lb />one of its by-now-routine 5-4<lb />votes, announced an ominous but<lb />little understood decision in<lb />Alexander v. Sandoval.<lb /><lb />Its history and the process by<lb />_ which this case got to the court, its<lb />actual holding, as well as its<lb />obviously intended implications,<lb />are throughly chilling, not only to<lb />the rights of minorities, its imme-<lb />- subject, but to all women as<lb /><lb />weil,<lb />The case involved coe by<lb />a Hispanic woman, Martha<lb />Sandoval, to a new<lb />by the state of<lb /><lb />requirement<lb />Alabama that<lb /><lb />Safety, was named as a defendant.<lb /><lb />That both the federal trial and<lb />appellate courts agreed with her<lb />was not suprising since the princi-<lb />ples she invoked had been recog-<lb />nized by the Supreme Court since<lb />the mid-1970s and repeatedly<lb />ratified by the Congress since<lb />then.<lb /><lb />What was shocking was the fact<lb />that the current high court took the<lb />case at all, and then it agreed with<lb />Alabama, a state that has an<lb />extensive record of resisting the<lb />rights of* minorities, to limit the<lb />scope of a vitally important civil<lb />rights protection. It was the sec-<lb />ond time this term that the court<lb />entertained a challenge by<lb />Alabama to a previously well-<lb />established civil rights protection.<lb />The other case involved the<lb />Americans with Disabilities Act.<lb /><lb />Sandoval brought her case under<lb />Title VI of the Civil Rights Act of<lb />1964, Title VI prohibits of federal<lb />financial assistance, and Alabama,<lb />like every other state, receives<lb />large infusions of federal transpor-<lb />tation money, In exchange for<lb />that bid, they are supposed to<lb />refrain from discrimination<lb /><lb />be tat impartial practices<lb />can have discriminatory impact.<lb /><lb />But aan apoet y impartial<lb /><lb />ices a tremendously<lb /><lb />Slserintnatiy impact on racial<lb /><lb />and ethnic minorities, as well asT<lb /><lb />the intent may have been benign<lb />does not soften the harsh effects.<lb />Thus, 30 years ago, a unanimous<lb />Supreme Court led by Warren<lb />Burger, the conservative chief, not<lb />the liberal Earl Warren, roundly<lb />condemned unintentional  dis-<lb />crimination that nevertheless<lb />harmed minorities, characterizing<lb />it as a obuilt-in headwind."<lb /><lb />Yet the current court, by a bare<lb />majority, has seen fit to limit<lb />access to federal courts to a<lb />challenge this kind of systemic<lb />discrimination when committed<lb />with the use of federal funds.<lb /><lb />Voting against Sandoval were<lb /><lb />Chief Justice William H.<lb />Rehnquist and Justices Anthony<lb />M. Kennedy, Sandra Day<lb /><lb />O'Connor, Antonin Scalia and.<lb />Clarence Thomas.<lb /><lb />The Sandoval decision will, in all<lb />likelihood, apply with equal force<lb />to similar provisions of Title IX of<lb />the Education Amendment of<lb />1972 that prohibits discrimination<lb />on the basis of sex in federally-<lb />assisted education programs.<lb />Similarly, the decision also can be<lb />expected to apply to Section 504<lb />of the Rehabilitation Act of 1974<lb />and Title Il of the Americans With<lb />Disabilities Act, which prohibit<lb />discrimination on the basis of<lb />disability in federally funded pro-<lb /><lb />Ss,<lb />Tne educational iti<lb />could be expect from challenge.<lb />pid ores and girls, this means<lb /><lb />Breer eset LEZ Mis FEA eae pres ne a rare ee RE Lt<lb /><lb />the aptitude test is supposed to<lb />predict.<lb /><lb />The result is that women must get<lb />higher grades in high school to<lb />gain an equal shot at admission to<lb />the same colleges as_higher-<lb />scoring men, and they may lose<lb />out on numerous scholarship op-<lb />portunities in which standardized<lb />tests are a deciding factor.<lb /><lb />Even more worrisome is the fact<lb />that the same ultra-conservative<lb />judicial activists have signaled<lb />their hostility to civil rights laws<lb />in general and to the use of the<lb />disparate impact theory, in par-<lb />ticular, and may very well be<lb />getting ready to jettison it from a<lb />whole range of civil rights protec-<lb />tion.
