Carolina<lb /><lb />In April 1877, William J. Whip-<lb />per, an African-American mem-<lb />ber of the South Carolina General<lb />Assembly, left office in the waning<lb />days of Reconstruction to assume<lb />alocal judgeship but was prevented<lb />from ever taking his seat on a<lb />bench. He was among the last Af-<lb />rican-Americans to serve in the<lb />General Assembly for the next 100<lb />years. Today, more than 100 years<lb />later, Seth Whipper, his great-<lb />great nephew, is fighting to retain<lb />his seat in the General Assembly<lb />and to vindicate the rights of the<lb />voters who put him there.<lb /><lb />That fight has now moved to the<lb />courts in a trial that recently con-<lb />cluded before a three-judge fed-<lb />eral panel in Columbia, S.C. The<lb />case received scant attention in<lb />the national press, but it is being<lb />closely watched by voting rights<lb />advocates and civil nights activists<lb /><lb />throughout the country. A deci-<lb />sionis expected before election day.<lb /><lb />The trial consists of two com-<lb />bined cases - Smith v. Beasley<lb />(challenging state Senate districts)<lb />was brought by a white former<lb />Democratic senator and a group of<lb />citizens; and Able v. Wilkins (chal-<lb />lenging state House districts) was<lb />brought by private citizens.<lb /><lb />The outcome of these cases, the<lb />first such legislative challenge to<lb />go to trial, will determine not only<lb />the fate of many majority-Black<lb />voting districts in South Carolina,<lb />but will indicate how vulnerable<lb />such districts are to attack by white<lb />voters and offfice-holders in light<lb />of the Supreme Court Ts recent re-<lb />strictions beginning with Shaw v.<lb />Reno in 1993.<lb /><lb />South Carolina has had a long<lb />and painful history of denying<lb />equal voting nights to its African-<lb /><lb />American citizens. Indeed, for the<lb />first 80 years of this century, not a<lb />single African-American served in<lb />the South Carolina Senate, al-<lb />though Blacks have comprised as<lb />much as 40 percent of the state Ts<lb />voting age population (a number<lb />that has declined to 27 percent in<lb />recent years). His suppliers used the<lb />profits to pay for the CIA-spawned<lb />Contra war versus Nicaragua Ts<lb />leftist government in the 1980s.<lb />Ricky Ts connections were first re-<lb />vealed in a series of articles pub-<lb />lished by the San Jose Mercury<lb />News and in court testimony.<lb /><lb />He granted The Final Call an<lb />exclusive interview at the Metro-<lb />politan Correctional Center, where<lb />he is awaiting sentencing on co-<lb />caine trafficking charges.<lb /><lb />The Contra connection<lb /><lb />In his interview, Ricky described<lb />how he was seduced into the lucra-<lb />tive cocaine brokering market in<lb />1981. Found guilty of willful miscon-<lb />duct by the jury in the civil trial, they<lb />were cach ordered to pay the plaintiffs<lb />$1 a week for the next 11 years. Many<lb />felt the pair had gotten off easy with that<lb />verdict.<lb /><lb />Both Mr. Sambor and Mr. Richmond<lb />played key roles in allowing the MOVE<lb />home to burn following a confrontation<lb />with the police. The fire started after a<lb />bomb was dropped on the home by the<lb />police.<lb /><lb />In his opinion, Judge Pollack seemed<lb />to classify the actions of Mr. Sambor and<lb />Mr. Richmond as dumb and dumber, but<lb />stopped short of finding willful miscon-<lb />duct, in ordering the reversal. Judge<lb />Pollack wrote, o... the evidence adduced<lb />at trial does not establish by a prepon-<lb />derance of the evidence that any one or<lb />more of the actions of either of the<lb />defendants constituted willful miscon-<lb />duct. ?<lb /><lb />Ramona Africa<lb /><lb />The judge reasoned that given the<lb />clear consequences, No matter how hos-<lb />tile Commissioner Sambor was towards<lb />MOVE, he never would have taken oso<lb />self-ruinous a course of conduct ? such as<lb />disobeying a direct order from a superior<lb />and then display treachery in misleading<lb />Commissioner Richmond.<lb /><lb />The point of contention was whether<lb />or not Mr. Sumbor and Mr. Richmond<lb />disobeyed a direct order from then City<lb />Managing Director Leo Brooks to put<lb />the fire out<lb /><lb />Jurors in the case certainly seemed to<lb />think they did. But they did<lb />in fact conspire to kill my brother, my<lb />son and those children and that was a<lb />willful act. It was all a ig conspiracy.<lb />The judge was in on it too. You can't get<lb />justice, ? she said<lb /><lb />Mr. Sambor had no comment on the<lb />ruling. Mr. Richmond said, oNo one<lb />went out there with evil intent. It was a<lb />matter of judgment. We had to make<lb />judgment calls and we were not always<lb />right. ?<lb /><lb />The judge did allow the jury's $1.5<lb />million verdicts against the City of<lb />Philadelphia to stand.<lb /><lb /> oThis shows the public that if you use<lb />the courts, go through the system, you<lb />still can't get justice, ? said Ramona<lb />Africa, the only adult to survive the<lb />blaze and leading plaintiff in the case.<lb />She had argued all along that forcing city<lb />officials to admit wrongdoing, not mone-<lb />lary compensation, was the<lb />her civil suit.<lb /><lb />Displaying the flery spirit she ts<lb />known tor, Ms, Africa told the press: oTt<lb />ain T Lover ?<lb /><lb />reason for .<lb /><lb /></p>

The case first began in<lb />1991, when the state Ts General<lb />Assembly failed to enact state and<lb />congressional redistricting plans<lb />to address the malapportionment<lb />demonstrated by the 1990 national<lb />census.<lb /><lb />In response to the assembly Ts<lb /><lb />federal lawsuit charging the exist-<lb />ing districts violated the<lb />Constitution Ts oone-person, one-<lb />vote ? principle as well as Section<lb />two of the Voting Rights Act, which<lb />prohibits dilution of voting power<lb />along racial lines. A three-judge<lb />panel was convened. At that time,<lb />Blacks constituted 27 percent of<lb />all registered voters, but only 13<lb />percentofthe members of the state<lb />House and 11 percent of the mem-<lb />bers of the state Senate.<lb /><lb />In Jan. 1993, while the lawsuit<lb />was pending, the General Assem-<lb />bly revised course and passed re-<lb />districting plans for the state<lb />House and Senate. The plans, how-<lb />ever, were vetoed by then-Gov.<lb />Carrol Campbell, who argued the<lb />legislature had, in fact, reduced<lb />the number of majority-Black dis-<lb />tricts and fragmented minority<lb />populations to the benefit of white<lb />incumbents.<lb /><lb />Several months later, in May<lb />1992, the three-judge federal panel<lb />issued its own interim state and<lb />congressional redistricting plan in<lb />response to the 1991 lawsuit. The<lb />plan, the judges ordered, was to<lb /><lb />Lite Reid<lb />Administrative Director<lb /><lb />The Children's Learning Tree Child Care Center<lb /><lb />(919)752-6593<lb />1902 Chestnut Street<lb />Greenville NC 27834<lb /><lb /> oWe Put The Care In Child Care "<lb /><lb />Ernestine Morris<lb />Director<lb /><lb />Carolina East Center<lb /><lb />(Across from Carolina East Mall)<lb /><lb />(919) 353-1617<lb /><lb />Featuring Experienced Professional Barbers ,<lb /><lb />Erskine Moore<lb />Bryan White<lb />Earl Evans<lb /><lb />(Formerly of Anderson's Barber Shop)<lb /><lb />Nicole Walston<lb /><lb />Hours<lb /><lb />obstruction, Black voters filed a<lb /><lb />take effect for the Nov. 1992 elec-<lb /><lb />tions, as well as for all subsequent<lb />elections until the legislature en-<lb />acted plans that met with the U.S.<lb />Department of Justice Ts approval<lb />under Section five of the Voting<lb />Rights Act.<lb /><lb />The judge Ts plans, however, were<lb />appealed, and in June 1993, were<lb />vacated by the U.S. Supreme<lb />Court. The high court ruled that<lb />the lower court had failed to ana-<lb />lyze its plans under the vote-dilu-<lb />tion standards of Section two, and<lb />remanded the case to the three-<lb />judge panel. Thejudges, frustrated<lb />that their interim plans had been<lb />vacated, gave the General Assem-<lb />bly a second chance to draft a plan<lb />which could pass constitutional<lb />muster.<lb /><lb />But the House leadership con-<lb />tinued to resist drafting true re-<lb />districting reforms. Then House<lb />Speaker Robert Sheheen, a Demo-<lb />crat, kept tight control of the en-<lb />tire process, limiting access to the<lb />computer used to plot new district<lb />lines and excluding the judiciary<lb />subcommittee, which is nominally<lb />responsible for redistricting, from<lb />negotiations. The state Ts Black<lb />Caucus, which was also excluded<lb />from the process, had proposed a<lb />plan that would have created ad-<lb />ditional Black majority districts,<lb />but it was rejected without discus-<lb />sion or debate.<lb /><lb />The result of all this was a House<lb />redistricting plan passed in Jan.<lb />1994 which, once again, had fewer<lb />majority black districts instead of<lb />more. The leadership Ts motives<lb />were clear: when asked why the<lb />House had rejected an additional<lb />black majority district in one of<lb />the countries, Speaker Sheheen<lb />replied, oBecause white Democrats<lb />are an endangered species. ?<lb /><lb />This time around, although<lb />Campbell refused to sign the re-<lb />districting legislation, he did not<lb />vetoit. Asa result, the House plan<lb />went into effect without his signa-<lb />ture, leaving its fate up to the<lb />Justice Department instead of the<lb />three judge panel.<lb /><lb />In May 1994 the Justice Depart-<lb />ment rejected the plan. Its oobjec-<lb />tion letter ? noted thatincumbency<lb />protection had driven the process,<lb />resulting in a plan that was retro-<lb />gressive, and that the state had<lb />failed to meet its non-discrimina-<lb />tion burden under the Voting<lb />Rights Act. The Justice Depart-<lb />ment also identified nine geo-<lb />graphic areas across the state<lb />where the potential to draw or<lb />enhance majority Black districts<lb />existed. The House was instructed<lb />to go back to the drawng board.<lb /><lb />By now, the Black Caucus was<lb />frustrated with the white Demo-<lb />cratic leadership, and mistrustful<lb />ofthe leadership Ts sincerity to pur-<lb />sue reform. The Caucus broke<lb />ranks to open negotiations with<lb />Republican members of the House,<lb />who were also feeling locked out of<lb />the redistricting process. With the<lb />assistance of an historian and de-<lb />mographer, the new coalition de-<lb />veloped acompromise plan, which<lb />was introduced over Sheheen Ts<lb />objections. The new plan, which<lb />contained 31 majority Black House<lb />districts, passed two days later on<lb />May 14.<lb /><lb />Soon after, the plan was ap-<lb /><lb /> ~Mit Calvary FWB Church Youth Department T<lb /><lb />Community Day<lb /><lb />YOUTH IN ACTION<lb /><lb />Date: September 28, 1996<lb />Time: 10:00am - 3:00pm<lb />Location: Mt. The govern-<lb /><lb />-ment had just announced that<lb /><lb />the guaranteed interest rate on<lb />U.S. Savings Bonds would drop<lb />from 7.5% to 6% on November 1,<lb />1986. They joined the tens of<lb />thousands of Americans who<lb />purchased bonds during those<lb />last four days of October 1986,<lb />making it the most intense pur-<lb />chase period in the history of the<lb />savings bond program.<lb /><lb />Sam and Betty were wise to<lb />lock in their bond investment at<lb />the 7.5% rate. However, are they<lb />aware that their investment is<lb />about to enter a period of sub-<lb />stantially lowered interest?<lb /><lb /> oContrary to what many bond<lb />holder Ts think, the rate of inter-<lb />est at purchase is not good for the<lb />life of a savings bond, ? says Dan<lb />Pederson, author of oU.S. Sav-<lb />ings Bonds: A Comprehensive<lb />Guide. ? In fact, all bonds pur-<lb />chased in the mid- | 980s with a<lb />7.5% guarantee carry an origi-<lb />nal maturity period of only ten<lb />years. After the first ten years,<lb />the bonds enter a ten-year ex-<lb />tension at anew guaranteed rate<lb />of 4%! Four percent is the best<lb />representation of what the bond<lb />will earn the first two to five<lb />years of the extension.<lb /><lb />If you don Tt track and manage<lb />your savings bond investments,<lb />the results can be more than just<lb />upsetting "they can be devas-<lb />tating. Suppose Sam and Betty<lb />were saving for retirement when<lb />they purchased $10,000 of Se-<lb />ries EE Bonds ($20,000 face<lb />value) in October 1986. If they<lb />believe that the 7.5% interest<lb />rate is good for the life of their<lb />bonds, they are expecting their<lb />investment to more than double<lb />in value every ten years. In other<lb />words, they are expecting their<lb />bonds to be worth $91,051 in 30<lb />years. In reality, the guaranteed<lb />interest rate drops from 7.5% to<lb />4% after ten years: Assuming<lb />that the guaranteed rate for their<lb />last maturity period is 7%, the<lb />value of their investment after<lb />30 years will be $61,740 "<lb />$29.311 less that they expected!<lb />(This example assumes that the<lb />combined market rates would<lb />produce a lower value that the<lb />combined guaranteed rates.)<lb /><lb />So how do you track savings<lb />bond investments? In fact, the<lb />November 1994 elections brought<lb />six African-Americans and three<lb />whites to the State House in the<lb />nine contested districts.<lb /><lb />In the spring of 1995, the South<lb />Carolina Senate passed a new re-<lb />districting plan for the Senate, with<lb />preclearance from the Justice De-<lb />partment, that created two addi-<lb />tional Black majority districts. The<lb />plan became law, and was to take<lb />effect for the 1996 elections.<lb /><lb />In response, a group of regis-<lb />tered white voters and Greg Smith,<lb />a former state senator, filed a fed-<lb />eral lawsuit in November 1995<lb />challenging three of the new Sen-<lb /><lb />ate districts, including the two<lb />Black majority districts. In Janu-<lb />ary 1996, another group of citizens<lb />filed a federal lawsuit against the<lb />state, charging that nine of the<lb />new House districts were uncon-<lb />stitutional under the Shaw v. Reno<lb />decision.<lb /><lb />The redistricting plan is being<lb />defended by South Carolina, and<lb />by a group of odefendant-interve-<lb />nors ?-African-American voters<lb />who, given past history, are con-<lb />cerned that the state would not<lb />provide an adequate defense. Ricky went to<lb />work and soon monopolized<lb />Cincinnati Ts virgin crack market,<lb />using the same strategies and<lb />Nicaraguan drug connections.<lb /><lb />He started selling crack as far<lb />away as Cleveland, Dayton, India-<lb />napolis and St. Louis.<lb /><lb />Ricky Ts luck ran out in 1988.<lb />One of his cocaine loads ran into a<lb />drug-sniffing dog at a New Mexico<lb />bus station and drug agents even-<lb />tually connected it to him. Ricky said. oThey wanted<lb />me to contact people on the streets<lb />and find out information. ?<lb /><lb />Forhis testimony, Ricky received<lb />five years off his sentence and an<lb />agreement that his remaining drug<lb />profits would not be seized.<lb /><lb />He was still behind bars in 1994,<lb />awaiting parole, when San Diego<lb />DEA agents targeted him for a<lb /> oreverse ? sting, one in which gov-<lb />ernment agents provide the drugs<lb />and the target provides the cash.<lb /><lb />Within days of his parole and<lb />return to Los Angeles in October<lb />1994, Ricky said, Danilocalled him,<lb />saying he had 600 kilos of cocaine<lb />worth about $12 million and he<lb />wanted Ricky to help sell it.<lb /><lb />Ricky said he initially decline<lb />butlater gave in to the persistent<lb />phone calls and obtained a buyer<lb />for 100 kilos of the cocaine Danilo<lb />claimed he had.<lb /><lb />On March 2, 1995, in a parking<lb />lot near San Diego, Ricky looked<lb />inside a cocaine-laden Chevy<lb />Blazer. The government really sand-<lb />bagged us. ?<lb /><lb />Ricky, who taught himself to<lb />read and write about five years<lb />ago, said he could be looked at two<lb />ways: As a villain or as a victim.<lb /><lb />Asked if he was ever concerned<lb />about how crack cocaine was af-<lb />fecting the Black community,<lb />Ricky admits, oNot at first.
