        <p>EASTERN NORTH CAROLINA'S MINORITY VOICE - SINCE 1987<lb /><lb />1 Von<lb /><lb />Minority Contractors Outraged<lb />At Supreme Court Ts Action<lb /><lb />by Alvin Peabody<lb /><lb />The recent decision by the United<lb />States Supreme Court to reopen<lb />already settled civil rights mat-<lb />ters through its review of the<lb />Adarand V. Pena decision related<lb />to federally-mandated women and<lb />minority business programs, has<lb />left numerous minority business<lb />entrepreneurs outraged.<lb /><lb /> oThis is an issue that threatens<lb />us and yes, I'm mad as hell, I Tm<lb />furious and I Tm really disgusted, ?<lb />said former U.S. Rep. Parren<lb />Mitchell who now chairs the Mi-<lb />nority Business Enterprise Legal<lb />Defense and Education Fund<lb />(MBELDEPF).<lb /><lb /> oWe find the courts T decision to<lb />review Adarand alarming because<lb />it is a construction, industry case, ?<lb />Mitchell said.  oThere are very<lb />modest affirmative efforts involved<lb />andin particular, because discrimi-<lb />nation in this industry has been<lb />recognized so often that federal<lb />courts have deemed it a proper<lb />subject for judicial notice. ?<lb /><lb />Last Thursday, Parren led a<lb />panel of Brick contractors on Capi-<lb />tol Hill to denounce the Supreme<lb />Court Ts decision to review the al-<lb />ready settled civil rights matter.<lb />At issue is the Adarand v. Pena<lb />case, which the high court has<lb />agreed to hear on appeal from a<lb />lower court.<lb /><lb />In its complaint, Adarand al-<lb />leged that the use of race as a<lb /><lb />factor in awarding federal procure-<lb />ment contracts in Colorado, with-<lb />out any findings of past discrimi-<lb /><lb />- nation in the state, violated the<lb /><lb />equal protection guarantees of the<lb />Fifth and Fourteenth Amend-<lb />ments,<lb /><lb />According to Parren and other<lb />minority supporters, the federal<lb />Small Business Act provides that<lb />the statutory authority for federal<lb />agencies to develop and to estab-<lb />lish certain utilization goals for<lb />disadvantaged small businesses.<lb />These goals must present the<lb /> omaximum practicable opportu-<lb />nity ? for small business concerns,<lb />including those owned and con-<lb />trolled by socially and economi-<lb />cally disadvantaged individuals ?<lb />to participate in federal contracts.<lb /><lb />But Adarand asserts that the<lb />proper standards to be applied to<lb />congressionally mandated pro-<lb />grams can be found in the Croson<lb />vs. City of Richmond case, which<lb />was deliberated on in 1989. But<lb />Black entrepreneurs do not hold<lb />Croson in much regard.<lb /><lb /> oThe last time the Supreme<lb />Court reviewed the constitution-<lb />ality of minority of minority busi-<lb />ness opportunity programs in<lb />Croson, minority business pro-<lb />grams in the state and local gov-<lb />ernments were summarily dis-<lb />mantled and hundreds of millions<lb />of dollars in opportunity were de-<lb />liberately and systematically de-<lb /><lb />nied to our businesses, ? argued<lb />Mitchell. To back up their claim,<lb />minority contractors note that be-<lb />fore Croson, there were over 230<lb />minority business development<lb />programs at the state and local<lb />levels. But six months after the<lb />Supreme Court decision, half of<lb />these programs were either dis-<lb />mantled, suspended or challenged.<lb /><lb /> oBy the year Ts end, they were<lb />gone and with them vanished hun-<lb />dreds of small and minority busi-<lb />nesses, ? said Nigel Parkinson of<lb />the National Association of Minor-<lb />ity Contractors.  oFive years since<lb />Croson, we have with enormous<lb />effort begun to recover. ? Joining<lb />Parren and the minority contrac-<lb />tors on Capitol Hill were NAACP<lb />Washington, D.C. Director Wade<lb />Henderson and Congressional<lb />Black Caucus T Chairman Kweisi<lb />Mfume.  oWe at the NAACP have<lb />always viewed economic opportu-<lb />nity as the cutting edge of the 21st<lb />century, ? Henderson said.<lb /><lb /> oIt is a challenge to the ability of<lb />Congress to speak to the redress of<lb />discrimination, ? the, civil rights<lb />leader noted.  oYet, we continue to<lb />see an ever-widening gap between<lb />the races when it comes to eco-<lb />nomic development. ?<lb /><lb />Mfume, who is chairman of the<lb />House Minority Business and En-<lb />terprise Subcommittee, described<lb />the Supreme Court's decision to<lb />review the Adarand case as  oan<lb />effort to undermine minority busi-<lb />ness to do business in this coun-<lb />try. ? Actually,<lb />this case will mostlike go down in<lb />history:  ~This is the first time a<lb />criminal case has beén referred by<lb />a state court to a tribal panel for<lb />punishment. I<lb />fouldn Tt help but-find this story<lb />very interesting. First and fore-<lb />most I know that Afrikan-Ameri-<lb />cans must do for ourselves. We<lb />must help ourselves. We must help<lb />ourselves solve our own problems.<lb />Rather than our problems being<lb />solved by others outside of our<lb />community. However, we may not<lb />have all of the answers or solu-<lb />tions all of the time. Sometimes we<lb />may have to look at what someone<lb /><lb />which best fit our agenda. In this<lb />case, banishment. Before anyone<lb />gets defensive or negative about<lb />this solution, please hear me out<lb />lrecognize the fact that Afrikan-<lb />Americans exist as a nation with-<lb />out land, so therefore it would be<lb />very difficult for us to even have<lb />enough clout to even get the oppor-<lb />tunity to banish anyone. But, let<lb /><lb />-us-look.at the possibilities. Think<lb /><lb />about it. Many of our youth ar <lb />hurting themselves and our com-<lb />munities. Because we are not in<lb />control of our lives we are left to<lb />turn our youth over to our enemies<lb />to discipline, punish or  orehabili-<lb />tate ? them. When<lb />such positive programs are strate-<lb />gically incorporated into our daily<lb />lives we might eliminate some of<lb />the problems we now have in this<lb />day and age.<lb /><lb />The Tlingit youths were afraid<lb />to go to prison. Roberts said,  oIt<lb />(banishment) will be a lot better<lb />than going to prison and being<lb />some guy's girlfriend. ? He went on<lb />to say,  oThe hardest people you<lb />meet are in prison. ? .<lb /><lb />Banishment is pretty much our<lb />of the question right now for the<lb />Afrikan-American nation. How-<lb />ever, I guarantee that we would<lb />all rest better ifonly we could send<lb />our troubled youth off to silence<lb />away from the societal noise. And<lb />you know what? Although these<lb />programs provide a  osafety net ?<lb />for many, the prevailing policy is<lb />one which keeps the poor barely<lb />suspended above total destitution,<lb />rather than creating ways out of<lb />the  osafety net ? trap and into an<lb />economically and socially develop-<lb />ing society. We could "if we, the<lb />people, instead of the politicians<lb />and bureaucrats, made the deci-<lb />sions "spend far less money on far<lb />more creative and effective social<lb />development programs. We could<lb />both cut taxes and improve peoples T<lb />lives. But to make that possible an<lb />entirely new environment, a  ode-<lb />mocracy environment ? must he<lb />created in which public and pri-<lb />vate sector policy is more directly<lb />shaped by the people of this coun-<lb />try. That's what Ts needed to stimu-<lb />late overall economic growth and<lb />social redevelopment "to improve<lb />education, create jobs and provide<lb />entrepreneurial opportunities so<lb />that our people don Tt have to de-<lb />pendon unemployment insurance,<lb />welfare, and food stamps to sur-<lb />vive. There must be a dramatic<lb />political restructuringin which the<lb />corrupt incumbent machines are<lb />tossed out of office and the full<lb />democratization of primaries and<lb />general elections brings the people<lb />of the country much more directly<lb />into the policy-making process.<lb />Term limits, initiative and refer-<lb />endum, recall, the elimination of<lb />PACs, and ballot access reform<lb />are key. It is now growing clear to<lb />both the African American com-<lb />munity and the white center that<lb />there are no governmental solu-<lb />tions to poverty, to the budget defi-<lb />cit, to's ing taxes and to<lb />violence in our streets as long as<lb />the government remains status<lb />quo. But there are political solu-<lb />tions to the crisis of government.<lb />Government must be completely<lb />and democratically overhauled as<lb />a precondition for curing our so-<lb />cial ills. In that job,<lb /><lb />MOVEt! Congresswoman Eva Clayton joined worshippers<lb /><lb />THE MOVE!<lb />Church during their homecoming activities recently.
