Because they<lb />never mutually established alle-<lb />giance with the federal govern-<lb />ment, they are not required to per-<lb />form the duties of citizenship, one<lb />of which is being taxed by the<lb />government.As the suit slowly<lb />moved through the United States<lb />District Court in Los Angeles,<lb />Ashton filed a motion for Request<lb />and Order for Judicial Notice of<lb />status of citizenship and the<lb />Fouteenth Amendmentunder Rule<lb /><lb />CONCER!<lb />together<lb />Toby Fi<lb /><lb />201, andin opencourt before Judge<lb />John Davies, at a hearing on Octo-<lb />ber 4, 1993 madea obold disclaimer<lb />to the Court of the:1. U.S. Consti-<lb />tution,2. 13, 14th Amendments,<lb />and Civil Rights Laws,3. and all<lb />other laws, statutes, rules, regula-<lb />tions, orders and commands of the<lb />United States on the grounds that<lb />Leonard Ashton and 49 millions of<lb />U.S. Slaves T Descendants of<lb />AfRIcan Origin National Ances-<lb />try had never consented, agreed<lb />to, or voted on or swore to uphold<lb />the U.S. Constitution and its laws<lb />and statutes, one of them being<lb />the I.R.S.Presently, the suit, on<lb />appeal to the Ninth Circuit Court<lb />of Appeals, lists four issues on<lb />which the refusal of slaves descen-<lb />dants to pay taxes is based, said<lb />Brock:A. Mutuality,B.<lb />Disclaimer,C. Domicile, andD.<lb />Jurisdiction based on<lb />Slavery.There is no showing, nor<lb />have the U.S. Courts answered, of<lb />any mutuality or consent through<lb />a jural process by Black slaves<lb />descendants to the U.S. Constitu-<lb />tion and laws as to associatio by<lb />citizenship, and it appears that<lb />the United States has agreed to<lb />this issue by their silence and re-<lb />fusal to answer, said Brock.In sup-<lb />port of Ashton Ts issue on mutual-<lb />ity, Brock pointed out that the<lb />following seven slave clauses in<lb />the U.S. Constitution negates any<lb />mutuality to the U.S. Constitu-<lb />tion, and further, said Brock, othe<lb />U.S. Constitution, used to enslave<lb />Blacks cannot be the means to free<lb />or make Blacks citizens. ?<lb /><lb />Slave Clause: oThe Migration or<lb />Importation of such Persons as<lb /><lb />ITIZENS. Her job would require her to<lb />travel the country explaining to<lb />African-American students why<lb />the University of Colorado would<lb />be worth their serious consider-<lb />ation. But the excitement sur-<lb />rounding her new position began<lb />to tarnish when a Black parent<lb />petitioned the chancellor saying oI<lb />wantjustification for why you hired<lb />her. ? Stewart recalls being over-<lb />whelmed by people who didn Tt feel<lb />she would represent Black issues.<lb />Why in the midst of our Afrocentric<lb />renaissance, should there be a bet-<lb />ter shade of Black? This month<lb />ESSENCE examines this critical<lb />issue. (Page 79)<lb /><lb />ESSENCE ON THE<lb />ISSUES:SHOULD CHILDREN<lb />BE TRIED AS ADULTS? <p>10-THE oM"-VOICE - WEEK ENDING SEPTEMBER 5, 1994 : oe<lb />Proud Sut<lb /><lb />Pitt County<lb />Schools T Double<lb />Standard<lb /><lb />oe eens<lb />their rights . °<lb />dren in the Pitt County Public School<lb />system this year. Sad as it is to say, our<lb />Subti odhatl Wise S908 bak Met sree<lb />tice racism,<lb /><lb />A case in point is a young African<lb />American female in a Pitt County el-<lb />ementary school who reported other<lb />mother in the school bathroom on two<lb />consecutive days while the teacher lost<lb />account of the children Ts whereabouts.<lb />According to the parent, two young males<lb /><lb />Gates Open 11:00 AM " es Si ot ee<lb /><lb />several times while explaining the sever-<lb /><lb />ity of the situation, only to be informed<lb /><lb />? . that the Superintendent was too busy.<lb /><lb />r ogr a m a " Finally, the parents went to the<lb /><lb />Superintendent's office. After persis-<lb /><lb />e ° ; tence, the Superintendent agreed to see<lb /><lb />them. The parents insisted that the school<lb /><lb />a ] n O r in e involved had made several attempts to<lb />cover up the alleged molestation.<lb /><lb />Finally, school officials agreed to sus-<lb />pend the male students involved for five<lb />days.<lb /><lb />Correct me if I am wrong, but this at<lb />the least represents criminal behavior<lb />on the part of the two students. It would<lb />have been much better if the school sys-<lb />tem had taken interest in this little black<lb />child in the same manner they would<lb />have their own children. The principal<lb />waited two days before reporting this<lb />attack tothe Superintendent's office. She<lb />also neglected having a conference with<lb />the parents of all the children involved.<lb />The school did not call Pitt County Social<lb />Services, the Greenville Police or offer to<lb />provide this child psychiatric attention.<lb />In fact, the school treated the parents as<lb />if they were second-class citizens. We<lb />wonder what would have happened ifthe<lb />principal had been black and the child<lb />had been white?<lb /><lb />Our children deserve the same rights<lb />and protection as do others. The school<lb />system should not pick and choose cases<lb />to pursue based on race and socio-eco-<lb />nomics. Had this been a white female<lb />who had been involved, no stones would<lb />have been left unturned.<lb /><lb />Pray for these parents and their child<lb />who have been treated differently be-<lb />cause they happen to be black.<lb /><lb />NAACP<lb /><lb />The recent firing of the National Ex-<lb />ecutive Director of the NAACP, Ben<lb />Chavis, says more about the ineptness of<lb />the organization that it does about<lb />Chavis. Admittedly, Mr. Chavis misguid-<lb />edly made decisions without board sanc-<lb />tions. No corporate body should allow<lb />representatives to pay off a private scan-<lb />dal with company funds without confer-<lb />ring with that body. After all, this body<lb />has to answer to corporate sponsors.<lb /><lb />Here lies the problem: For years the<lb />NAACP has been controlled by the phi-<lb />losophy of its corporate sponsors, This<lb />has greatly diluted the integrity and<lb />power of this dying organization. The<lb />Board of Directors for this organization<lb />(the Black Who Ts Who in America) has<lb />become philosophically itinerate in its<lb />scopes of the future, trying to articulate<lb />the aspirations of blacks while depend-<lb />ing on financial survival of white corpo-<lb />rations, has greatly compromised the<lb />potency of the organization.
