FACULTY SENATE MINUTES
January 21, 1986

The Senate met in a special called session on Tuesday, January 21, 1986 in
Mendenhall Room 244, at 2:10 p.m., chair Ken Wilson presiding.

Members absent were: Capen (Business), Ferrell (History), Jones (Science
Education), Knoke (Aerospace), O'Brien (Medicine), Terrell (Education), and

Chancellor Howell.

Alternates present were: Mehne for Laupus (Medicine), Steele for Gallagher
(Home Economics), Sadler for Catlett (Library and Information Studies),
Broadhurst for Sparrow (Technology), and Holt for South (English).

Dr. Trenton Davis, Professor or Environmental Health, has been appointed
Associate Vice Chancellor for Academic Support. Dr. Davis has resigned
as Chair of the Faculty Senate Credits Committee since assuming his new

Yole as Associate Vice Chancellor.

Associate Professor Anne Briley retired from the University January 1,
1986 leaving a vacancy on both the Faculty Affairs and the
Reconsideration Committees.

There is a correction to the Spring 1986 Examination Schedule:

The 1:00 T & Th exam should be administered from
2:00-4:00 p.m., Thursday, May 8, 1986

There was an error in the memo to all faculty concerning election of
Faculty Assembly representatives. The term of alternate representative,
Stephen Thomas, Allied Heaith & Social Work, should have been listed
1985-88 instead of 1983-86.

Current UNC policies prescribe that a faculty member must file his or her
“written notice of appeal" within ten calendar days of receipt of notice
of the decision from which he wishes to appeal. Administrative
Memorandum 230 from President Friday clarifies this time limit.

 
Concern has been expressed by members of the University community that
the prescriptions concerning a ten-day limit on filing notice may be
understood or interpreted to require the grievant to present his complete
appellate case (i.e., appellate record, written arguments, etc.) within
the ten-day period. Such was not the intention of the Board of
Governors, and no such approach has been followed by this office in
responding to requests for review addressed either to the President or to
the Board of Governors. Rather, the consistent interpretation has been
that the ten-day limit applies only to require that a simple “notice” of
request for review be filed in a timely manner. Thereafter, staff of
this office responds by prescribing a chronological listing of steps, and
corresponding due dates, which are essential to perfection of the appeal
for consideration by the appellate body, e.g., submission of the proposed
record on appeal, response to such submission by the original
decisionmaker, submission of stated grounds for appeal and accompanying
arguments, reply by the decisionmaker, etc. Such a calendar is
constructed in a manner designed to assure completion of these
preliminary steps on a schedule that permits the appellate body to
consider and resolve the appeal within the limited timeframe prescribed

for its action.

7. The meeting date for the fifth regular Senate meeting is Tuesday, January
28, 1986 rather than Monday.

Agenda Item III A: Agenda Committee Report

Carl Adler reviewed the history and need for procedures to fulfill a balanced
slate according to Mr. Kinsey's criteria.

He reported on receiving from John Maiolo objections to item number 7 on the
grounds they might be construed as antagonistic, and might forfeit the
faculty's privilege to have input into the search procedure.

Eugene Ryan questioned number 5, especially the words “need to" which seem to
contradict number 7. It was clarified that "probably should” was the intent
of the Agenda Committee.

Constantine Kledaras questioned whether the division included Professional
Schools, Medical School and Arts & Sciences.* Gooding questioned if two people
from Arts & Sciences and one from the Med School would satisfy the division.

The Chair replied in the affirmative.

Beatrice Chauncey commented that there should be representation by the kind of
people who know how to examine the applications and read human nature, and
perceive who would be a good administrator.

R. Fulghum and R. Morrison questioned the eligibility requirements for the
nominees.

Morrison moved that people who are nominated must be in tenure track faculty
positions. It was seconded by Boyce and the motion passed as item number 8.

C. Kledaras noted that nominations have been made after careful consideration
of the criteria.

Ed Ryan asked if any on the current list of nominees do not meet the
requirements of number 8, Vice Chancellor Volpe replied that all nominees from
Academic Affairs met the requirements, and P. Mehne (alternate for Laupus)
noted that Dr. Zubie Metcalf is EPA administrative staff.

Dr. Duckett does meet the requirements.

The questions was called on the amended committee report and it passed on a
voice vote.

1a Nominations will be accepted from the floor providing
prior consent of the nominee has been obtained and
information on the nominee's qualifications is made
available to the Senators.

All nominees should be clearly identified as to unit
of origin.

Ail nominees should be clearly identified as to
“minority” status.

Each of the three positions should be nominated and
elected separately,

After the first election has been successfully completed,

the Chair should specifically mention the character of the
nominees needed for the remaining positions, e.g., “Having
selected Professor Rocky Wasp from the Department of Abstract
English for the first position, we need to select a member
from the Medical School and/or a minority/woman for our

next nominee".

If there is not an election after a given ballot, all
nominees with less than ten percent of the total number
of votes cast will be dropped from the nominee list prior
to the next ballot.

All faculty should be eligible for nomination at each stage
regardless of their unit of origin or minority status. If,
after having given Mr. Kinsey's wishes serious consideration,
the Senate ultimately selects three candidates who do not
completely mirror the criteria as outlined by Mr. Kinsey, they
are the best three choices and should be forwarded to

Mr. Kinsey.

People who are nominated must be in tenure& track faculty
positions.

The meeting adjourned at 2:42 p.m.
