Last<lb />month BRAGG BRIEFSexposed the comm-<lb />and influence that was exerted to<lb />reinstate certain charges that the<lb />Navy had dropped apparently because<lb />they felt they couldn't make them<lb />Stick. New information indicates<lb />that the powerful chairman of the<lb />House Armed Services Committee,<lb />Mendel Rivers, had something to<lb />do with bringing charges against<lb />Priest in the first place. It seems<lb />that Roger printed a snort oParab-<lb />le of Bobby Seale� that included<lb />a Slap at Rivers in the June,1969<lb />issue of OM. Rivers wrote a letter<lb />dated June 6,1969, to Rear Admiral<lb />Means Johnston at the Department<lb />of the Navy suggesting the Priest<lb />had committed a gross exaggeration<lb />of free speech. If Priest is con-<lb />Victed he faces 39 years in jail,<lb />and the conviction will, in effect<lb />repeal the First Amendment and<lb />freedom of speech for G.I."s. As<lb />a result, every G.I. publication<lb />will be subject to the same re-<lb />pression.<lb /><lb />Anyone who follows Congression-<lb />al Defense legislation knows that<lb />Mendel Rivers is nothing but an<lb />agent of the Pentagon in the House<lb />of Representatives. His district<lb />in South Carolina is so full of<lb />defense installations that the city<lb />of Charleston practically owes its<lb />life to him. Roger Friest and the<lb />publication of every other anti-<lb />War G.[. newspaper represent a<lb />threat to the Pentagon, and a thr-<lb /><lb />(Continued on page 2)<lb /><lb />and for their concern for the happiness and<lb /><lb />Their experience has proven something essen-<lb />of movement goals and strategies.<lb /><lb />Donation Free to Servicemen<lb /><lb />Hoffman Sentences Chicago<lb />Conspiracy Eight<lb /><lb />CHICAGO (LNS) = The cluttered defense table at the trial of the<lb />Conspiracy Eight in Chicago was finally cleared of defendents on<lb />February 15th, as the last of the men on trial for conspiring to<lb />riot at the 1968 Democratic National Convention, along with defense<lb /><lb />attorneys, were sentenced to prison terms for contempt of Julius J<lb />Hoffman's court<lb /><lb />Beginning with Dave Dellinger<lb />and reading verbatim from the<lb />trialTs transcript, the judge<lb />scored DellingerTs shouted sup-<lb />port of Bobby Seale when the Pan-<lb />ther leader was shakled by the<lb />judge. Hoffman ran through in-<lb />Stance after instance when Del-<lb />linger spoke out against the pol-<lb />itical nature of the trial, the<lb />lies, and the distortions.<lb /><lb />When Hoffman was through, he<lb />gave Dellinger a chance to speak.<lb />Dave talked about the war against<lb />Vietnam and about racism in this<lb />country. The judge told him that<lb />the trial was not about politics.<lb />Dave told the judge that that is<lb />exactly what the trial is about.<lb />Judze Hoffman warned him not to<lb />go on talking about things like<lb />thats; but Dave kept on talking:<lb /><lb />oYou want us to stay in our<lb />place, Judge Hoffman, but we<lb />won't. Just like black people<lb />won*t stay in their place, or<lb />poor people, or women won't Stay<lb />in their place. First you wanted<lb />us to be like good Germans and<lb />Say nothing about the evils of<lb />this decade. Now you want us to<lb />act like good Jews and go quietly<lb />to the slaughter. The record igs<lb />an indictment of you, not us. If<lb /><lb />you had any sense, Judge Hoffman,<lb />you'd realize that this trial<lb />will be the rallying point for a<lb />whole new generation.�<lb /><lb />Shouts of "Right ont" rang out.<lb /><lb />"Sit down, Mr Dellinger. Mis-<lb />ter Marshall, have that man sit<lb />down,� the judge said.<lb /><lb />Dave's daughter, Tasha, ap-<lb />plauded her father. Judge Hoffman<lb />looked at her, furious, and order-<lb />ed her thrown oute Tasha gripped<lb />the back of her seat as a burly<lb /><lb />woman marshall pulled her to the<lb />ground.<lb /><lb />The courtroom exploded. Séveral<lb />Conspiracy staff members hurled<lb />themselves into the middle of the<lb />melee to protect Tasha. Screams<lb />and shouts rang out and the entire<lb />room was on its feete Dave tore<lb />himself from the marshalls and ran<lb />up to Tasha, shouting, "That's my<lb />daughter! They're hitting my daugh-<lb />ter! Detachment<lb />lst Special Forces Group, Okinowa<lb />and formerly of Fort Bragg. there<lb /><lb />are already other chapters of G.I1es<lb />United at Fort Jackson, Fort Gordon<lb />and of course Fort S5rageg<lb /><lb />The Brass. immediat ely tried to<lb />squelch the group orn January 25<lb />when they staged crake. Pipat action.<lb />Cpl. John Dipple, Mark Malone and<lb />Sgt. Roger Kingsley began passing<lb />out leaflets on the Fort Buckner<lb /><lb />military instillation. The leaf-<lb />lets stated reasons why Vice<lb />President Agnew did not visit<lb />Ckinowa on his far eastern tour.<lb /><lb />The G.I.s were brought. in by the<lb />M.P.s after handing out approximate<lb />ly 85 leaflets. M.I. to deter-<lb />mine if any breach of security<lb />was involved,they were returned to<lb />their unit. A rece<lb />ent Pentagon statement says there<lb />are "576 American deserters in<lb />Canada" and that in oonly 107<lb />cases� was there evidence the de-<lb />sertion was in protest of the war<lb />in Vietnam. The American Deserters<lb />Committee estimates there are 3<lb />to 6 thousand deserters in Canada<lb />and records show that in over 50%<lb />of the cases men have left the<lb /><lb />military and the U.S. after they<lb />had received orders for Vietnam.<lb /><lb />Paul Petri of the ADC says,<lb />"the Pentagon believes that the<lb />American people will accept any-<lb />thing it says. Well we don't; in<lb />this case, we know they~re wrong.<lb /><lb />HANOI (LNS) = oI am now in the<lb />Service of the Vietnamcse people<lb />in their struggle against the<lb />imperialist aggressor. You may<lb />think I am a traitors; yes, a<lb />traitor to the U.S. of Rockefel-<lb />lers and Morgans and all the rest.<lb />I have never been nor ever will<lb />be a traitor to the American peo-<lb /><lb />ple, for they are opposed to this<lb />brutal war,"<lb /><lb />oThis is a small portion of an<lb />open letter from a black rebel<lb />marine who has left the American<lb />forces in Vietnam to fight for<lb />the liberation of the Vietnamese<lb /><lb />But last December, the Judge Advocate people with the National Libera-<lb /><lb />General's office overturned the<lb />court martial, affirming that Pet-<lb />ersen had been the victim of ill-<lb />egal search and seizure, that due<lb />process of law had been violated<lb />in trial procedure, and that when<lb /><lb />~compared to sentences for similar<lb /><lb />offences, 8 years was ocruel and<lb />unustial� punishment.<lb /><lb />It is written to his<lb />former comrades-in-arms. Fin-<lb />ly, they called the MP*s who<lb />nt a jeep, but when they arrived<lb />ey didn*t disturb the petition-<lb />Se<lb /><lb />Not knowing what to do, the MPs<lb />lied headquarters who in turn<lb />lled JAG. Approximately half an<lb />ur later, a squad car with an MP<lb />id a JAG lawyer pulled upe The MP<lb />ked to see the petition, but<lb />en returned it and asked for the<lb />nes of the two petitioners. They<lb />en left.<lb /><lb />The two petitioners collected<lb />2r 100 signatures that afternoon<lb />i by the end of the week, GI's<lb />ITED had collected over 500 sig-<lb />tures. The drive will continue<lb />til there are over 2,000 signa-<lb />res, then the petitions will be<lb />ad carried to Congress by GI's.<lb /><lb />People ask me who my heroes<lb /><lb />~e, I have only one = Adolph<lb />.tler<lb /><lb />Marshall Ky, dictator<lb /><lb />.CISTFACISTFACISTFACISTFACISTPIG<lb /><lb />cartoon by Fred Wright<lb /><lb />oDo you want a wage increase or would<lb />you rather be a patriotic American?�<lb /><lb />Restraining Orders<lb />stop court-martials<lb /><lb />At the present time, there are<lb />four individuals at Ft Bragg who<lb />nave stopped the Army from court-<lb />martialing them.<lb /><lb />If a soldier exhausts his ad-<lb />ministrative remedies when filing<lb /><lb />for discharge and is unable to se-<lb /><lb />cure release, he can file suit in<lb />the federal courts to contest the<lb />legality of his detention in the<lb />military. During the time his case<lb />is being reviewed he can obtain<lb />restraining orders stopping any<lb />court-martial from proceding.<lb /><lb />In Feb 1969, the first such re-<lb />straining order was issued against<lb />the Bragg officials and as yet the<lb />courtemartial of the individual<lb />involved has not taken place.<lb /><lb />Since that first restraining<lb />Order at Bragg, there have been<lb />three other such orders issued.<lb />These four individuals have been<lb />successful in preventing their<lb />court-martials and hopefully they<lb />are helping to end the power of<lb />the Army to court-martial anyone.<lb />Perhaps the army should have lim-<lb />ited power to punish by restrain-<lb />ing or fining a soldier. However,<lb />they should not have-the power to<lb />imprison especially now when court<lb />martials are political trials.<lb /><lb />If a person has commited a<lb />crime serious enough to be put in<lb />jail then he should be tried by<lb />the court of his country and this<lb />does not include the military<lb />courts. Most people who have been<lb /><lb />Write Onll!<lb /><lb />David Wachter and Richard Yahr,<lb />two very active members of GI's<lb />UNITED have been honorably dis-<lb />charged from the Army. With early<lb />outs for school, they are now on<lb />campus, confident that GI's UNI-<lb />TED will continue the work they<lb />helped start. If<lb />Roger can be tried for UCMJ char-<lb />ges amounting to 39 years in jail,<lb />then he should be tried by the<lb />courts of tnis land - the federal<lb />courts. How can the brass be obe-e<lb />jective when Roger's charges re-<lb />sult from his opposition to the<lb />military and its goals?<lb /><lb />A conscientious objector won't<lb />receive a fair trial if he refuses<lb />to train in the methods of killing<lb />and has to appear before brass who<lb />have supported war and killing for<lb />years. A person canTt receive fair<lb />treatment if ne*s known as a pol-<lb />itical dissenter trying to change<lb />the very system that will pass<lb />sentence upon him.<lb /><lb />A recent example of the brassT*<lb />fear for security is the case of<lb />Lt Calley. No matter whether or<lb />not a person feels he's guilty,<lb />its difficult for anyone to feel<lb />that Calley will receive a fair<lb />trial, especially when the brass<lb />know our Commander-in-Chief said<lb />Calley would be punished if he is<lb />found guilty. Perhaps a civilian<lb />court would expose more individ-<lb />uals that might be involved even<lb />if. it is higher ranking brass. "<lb /><lb />We must act now to end a sys-=<lb />tem which denies a fair trial. If<lb />the brass must ocover their own<lb />asses", then let them find some<lb />other way than being able to im-<lb />prison people. Its possible they<lb />may pass legislation. ending this<lb />kangaroo court system. However,<lb />until it is passed we must work<lb />together to stop the UCMJ.
