Their work at the Quaker House was essential to the development<lb />of a potent liberation movement in the Fayetteville area.<lb /><lb />were killed in an automobile accident in Geor ja on December<lb /><lb />Februar<lb /><lb />OTBrien Charges Not Dropped<lb /><lb />Sometime between the 19th<lb /><lb />of December snd the 13th of Jen-<lb />ary, the authorities at Fort<lb />Bragg decided that the court-<lb />mertial cherges Same st David<lb />O'Brien had not be dropped.<lb />Col, William R. ines of the<lb />basic trainins center informed<lb />O'#rien of this fact on the 13th<lb />of January. Major Bush, the<lb />adjutent, later explained to<lb />O'Brien that CPT Coates of his<lb />ola unit had been told the<lb />chsrg=s would vorobably be drop-<lb />ped, that Coates hsd then told<lb />him thet the charges had in<lb />fact been dropped, but that the<lb />final decision made was that<lb />O'Brien would only be taken out<lb />of trainee status and transfere<lb />red to another part of the<lb />training center. The error was<lb />soparently discovered when the<lb />Chrictmas issue of Bragg Briefs<lb />which included an article about<lb />the charges being dropved found<lb />its way into the hands of the<lb />Ft, Brags authorities. Jackson<lb />Coffeehouse<lb /><lb />CLOSED<lb /><lb />Columbia, S.C...On January 13,<lb />a warrant was issued by Judge E.<lb />Harry Agnew ($?!) for the arrest<lb />of five members of the UFO Cof-<lb /><lb />feehouse staff. In conjunction<lb />with the arrests, a temporary re-<lb /><lb />straining order closing the UFO<lb />was issued on the 15th, charging<lb />the coffeehouse operators with<lb />keeping and maintaining a public<lb />nuisance. More specifically, the<lb />indictment cites the UFO as a<lb />gathering place for opersons of<lb />evil name, fame, and conversation,<lb />men as well as women,� as having<lb />displayed printed matter which<lb />was oobscene and offensive�, and<lb />with aiding, encouraging, entic-<lb />ing, and allowing ominors under<lb />the age of 21 to become incor-<lb />rigible and ungovernable or hab-<lb />itually disobedient beyond con-<lb />trol of his or her parents or be-<lb />come habitually truant, associate<lb /><lb />with immoral and vicious persons.�<lb /><lb />The UFO has been under inves-<lb />tigation by several agencies,<lb />both civilian and military, since<lb />its opening in 1967. The county<lb />prosecuting attorney admitted<lb />that the arrests were only part<lb />of an effort to close down the<lb />building; he said, oThere are a<lb />lot of ways to do this thing� and<lb />that they had picked a orarely<lb />used legal move" as the oquickesv<lb />and surest way", all of which<lb />would indicate that the charges<lb />are at least extraneous, if not<lb />entirely unfounded, and that the<lb />primary objective of this move is<lb />to silence the UFO which has been<lb />active in GI organizing and pro-<lb />test against the war.<lb /><lb />Jon Kraus, president of the<lb />South Carolina chapter of the<lb />American Civil Liberties Union,<lb />has called the move by Columbia<lb /><lb />(Ft.Jackson continued on pg.2)<lb /><lb />Dean and Kay<lb /><lb />lst.<lb />Free to Bri<lb /><lb />Brag<lb />Suit ee<lb />and Appealec<lb /><lb />On January 2nd, Judge Alger-<lb />non L. Butler denied motions of<lb />attorneys for GI*s UNITED demand<lb />ing immediate distribution right<lb />on post of the publication Bragg<lb /><lb />Briefs. The long awaited decisio<lb /><lb />from a November 12th hearing was<lb />less than four pages in length.<lb />In it, Butler reviewed the facts<lb />of the case without discussing<lb /><lb />the points of law in favor of or<lb />against the GI's first amendment<lb />rights. He concluded with three<lb />points: (1) That AR 210-10 and<lb />Ft Bragg Reg 210-23 are consti-<lb />tutionally valid. (2) That Bragg<lb />Briefs constitutes a basis upon<lb />which General Tolson could rea-<lb />sonably conclude that distribu-<lb />tion would present "a clear dan-<lb />ger to the military loyalty, dis<lb />cipline, and morale� of soldiers<lb />stationed at Ft Bragg. (3) That<lb />the evidence failed to establish<lb />any denial of constitutional<lb />rights. An appeal has already<lb />been filed with the 4th Circuit<lb /><lb />Court of Appeals.<lb />(Continued on editorial page 6)<lb /><lb />Chaplain vs Bishop<lb />State vs Church<lb /><lb />On January 7, Colonel Gefell<lb />the commanding chaplain at Fort<lb />Bragg and incidentally a Roman<lb />Catholic priest, refused to aid<lb />a bishop of his church who wish¢<lb />to give comfort to the prisoner:<lb />in the post stockade. Bishop An:<lb />tulio Parilla-Bonnilla of Puert<lb />Rico requested that the colonel<lb />intercede with General Tolson t<lb />gain entrance to the stockade aj<lb />ter he had been refused admit=-<lb />tance at the gates. Not only dic<lb />Gefell turn down the bishop's<lb />request, but he would not even<lb />permit the bishop to use an Arm<lb />telephone to call Tolson - sug-<lb />gesting that the bishop use the<lb />pay phone outside instead. Bail was<lb />set at $28,500 for the four, a<lb />clear violation of, amoung oth-<lb />er things, the new SC Bail re-<lb />form Act.<lb /><lb />its<lb />definitely<lb />lappening man!<lb /><lb />Yeh,<lb /><lb />The Roger Priest Case<lb /><lb />Free Speech vs<lb /><lb />Roger Priest, U.S. Navy, is<lb />inder court-martial which could<lb /><lb />~eSult in a dishonorable dis-<lb />~charge and up to 39 years in<lb />rison. No, Roger isn't that per-<lb />~on charged with over 100 counts<lb />~f murder. Roger*s court-martial<lb />S based upon his views and the<lb />xpression thereof.<lb /><lb />Under the infamous Article<lb />34 of the Uniform Code of Mil-<lb />tary Justice, he has been char-<lb />ed with oadvising and urging<lb />nsubordination and disloyalty<lb />ith intent to interfere with,<lb />mpair, and influence the loyal-<lb />ys morale, and discipline of<lb />ilitary and Naval forces."<lb />hese charges were pressed short-<lb />y after Roger published a news-<lb />aper entitled OM = The Libera-<lb />ion Newsletter,<lb /><lb />There were 14 charges in all<lb />iled by the U.S. Navy in June<lb />969. Since that time some of<lb />he original charges have been<lb />ropped and the court-martial it-<lb />elf has been delayed while the<lb />eS. Court of Military Appeals<lb />ules upon Priest's allegation of<lb />Ommand influence in the matter,<lb />he court-martial judge original-<lb />y dismissed two charges but lat-<lb />r reinstated them after the ad-<lb />iral pressing the charges told<lb />im to reconsider his decision,<lb />ne decision by the Military<lb />ourt of Appeals could set a<lb />egal precedent for future<lb />Surts-martial.<lb /><lb />The most important aspect of<lb />2#ger*s case is not the idea of<lb />LS commander directly influenc-<lb />1g the court-martial. The in-<lb /><lb />Command Influence<lb /><lb />Marches protesting the closing<lb />were staged in downtown Columbia<lb />on the 16th and 18th of January.<lb />Speakers at the larger rally on<lb />the 18th (500 attended on about<lb />three days notice) included How-<lb />ard Levy who was instrumental in<lb />starting the UFO while he was in<lb />prison for refusing to train<lb />Green Beret medics, Mark Lane<lb />who promised to aid and abet any-<lb />one involved in GI organizing or<lb />protest against the war or any-<lb />one willing to desert to Canada<lb />or elsewhere, and Clay Greene of<lb />Ft Jackson. Pvt<lb />Dennis Halliday, an 8 month basic<lb />trainee from Bragg, is one of the<lb />millions ordered oto do his duty"<lb />Unlike the majority of Americans,<lb />Dennis refused to become a traine<lb />killer. He refused to train in t<lb />tactics of killing and for his re<lb />fusal Dennis is pending a special<lb />court-martial.<lb /><lb />While his detention by the Arm<lb />is being contested in the federal<lb />courts, Dennis® lawyers got a re-<lb />straining order. from the court pr<lb />venting the Army from going ahead<lb />with the court-martial. Dennis<lb />now awaits a decision on his fede<lb />eral court hearing, fully realiz-<lb />ing that if he looses he will be<lb />court-martialed for refusing to<lb />learn how to kill.<lb /><lb />Organize!<lb /><lb />Most of us as GeIe~'s have<lb />gripes and valid complaints re-<lb />garding our involuntary tour in<lb />the military. The term F.T.A-<lb />is an example of how we feel<lb />about our life as servicemen.<lb /><lb />If we just sit around the<lb />barracke continually griping<lb />about the war, living condi-<lb />tions, haircuts, chow, or what-<lb />ever it may be, we are actually<lb />helping the Army.<lb /><lb />There is only one way to<lb />bring ahout change and that<lb />is to work together to bring<lb />Change. We can't just gripe<lb />about our problems. If the<lb />60,000 soldiers from Bragg<lb />join together then we can de-<lb />mand and gain more important<lb />demands. Stop griving and<lb />start acting. G.I~'s United<lb />helped you in gaining changes<lb />in the haircut regulation. We<lb />must begin now for more impor-<lb />tant changes.<lb /><lb />Help end the War! There are<lb />3% million men in the service...<lb />certainly 3% million men can de-<lb />mand an end to the war now,<lb />rather than waiting, as one man<lb />wants to, for years.           <lb />February 1970 BRAGG BRIEFS Page 4 February 1970 BRAGG BRIEFS<lb /><lb />Army does lasting harm to Family Structure in America<lb /><lb />In vast issues, Bragg Briefs<lb />has tried to show some of the in-<lb /><lb />dignities and devrivations that<lb />the average GI is forced to bear<lb />while serving his country as a<lb />oart of the militery machine,<lb />Not the least of these is the<lb />mental anguish of being separa-<lb />ted from his wife, family, or<lb />even his girl friend back home<lb />for extended veriods of time,<lb />Not only does the arny ignore<lb />this deplorable sta_e of arfairs,<lb />but it often uses such separa-<lb />tions to force dissident sol-<lb />diers into submission or to oun-<lb />ish them for acts not demed ac-<lb />ceotable by military standards,<lb /><lb />How often have you<lb />known fellow GlTs<lb /><lb />with family strife<lb />or marital problems?<lb /><lb />We of GI's United submit that<lb />this is unjust punishment and<lb />constitutes undue mentel cruel-<lb />ty, not only to the solcier in<lb />question, pout also to the ver-<lb />son or persons being deorived<lb />of the confort of his oresence.<lb />Though such mental anguish is<lb />often only of a temporary nature,<lb />it can and does destroy the mar-<lb />riages and lives of hundreds of<lb /><lb />people every year. To illus-<lb />trate this voint we airect your<lb /><lb />attention to the case of one of<lb />the editors on our staff. Our<lb />editor, who was married in No-<lb />vember of 1968, received orders<lb />for Korea in January of 1949<lb />after heving been married for<lb />only 2% months. At this time,<lb />his wife began exhibiting ten-<lb />dencies toward emotional insta-<lb />bility which related directly to<lb />their impending seoaration. He-<lb />alizing that his wife~*s emotion-<lb />al health was seriously tT ureat-<lb />ened by such an assignme~.t, our<lb />editor attempted to have his or-=<lb />ders changed to oreclude his<lb />being sent overseas. When offi-<lb />cial channels oroduced no re-<lb />sults, he sooke to his father,<lb />who at that time was an active<lb />army colonel stationed at the<lb />Pentagon. Even this attempt<lb />failed, and despite his efforts,<lb />he was reassigned to Korea in<lb />February 1949. His wife was<lb />placed under doctorsT care in<lb /><lb />his absence and it became more<lb />than evident that eny further<lb />separation would be disasterous<lb />not only to ner health, but to<lb />their marriage as weil. On these<lb />grounds, our editor anolied for<lb />a compassionate reassignment and<lb />was turned down for the typical-<lb />ly inane reasons the army seems<lb />te reserve ror such requests.<lb /><lb />As a result, his wife became osy-<lb /><lb />chotic and he is presently fac-<lb /><lb />ing impending divorce. Too late,<lb /><lb />the army recognized the serious-<lb />ness of the situation and in<lb />September 19469, he was reassigned<lb /><lb />to Fort Bragg, where he is pvre-<lb />sently stationed. The dnage,<lb />however, nsd alreacy been done,<lb />and as it now stands, his wife<lb />may be vernsnently criooled emo-<lb />tionally, and an otnerwise happy<lb />marriage has been destroyed.<lb /><lb />If this were an isolated case,<lb />it night be excusable, but with<lb />minor variations it is @ common<lb />ocurrence in the military today.<lb /><lb />According to statistics, one out<lb /><lb />of every tnree marriages in the<lb />United States today results in<lb />a divorce, and since tnis estoun-<lb />ding figure has been true for<lb />only a convaratively short time,<lb />it would avpear that it relates<lb />directly to the Vieénam build-<lb />Ude Though the news media<lb />tends to exvlain these figures<lb />by citing the rising incidence<lb />ofdrug abuse, the lowering of<lb />American morals, and marrying<lb />too young as the causes, we sub-<lb />mit that the all too common ene-<lb />forced senarations broucht about<lb />by our presence in Vietnam and<lb />other hsrdship tour areas has a<lb />direct bearing on the increased<lb />divorce rate in the US today.<lb />Due to tneir age, most of the<lb />married enlisted men in the low-<lb />er five ranks have been married<lb />only a comoaratively short time<lb />before they are forced into mie<lb />litary service. The time need-=<lb />ed to develop the lasting and<lb />permanent bonds so necessary for<lb />a successful marriage is not a-<lb />vailable to these youn couples,<lb />and as &amp;@�,�-consequence,,thsir mar-<lb /><lb />riages are almost doomed to fail-°<lb /><lb />ure from the start if they are<lb /><lb />seoarated for any length of time.<lb />How often have you known fellow<lb />GI's with family strife or mari-<lb />tal problems? Is the incidence<lb />of broken or unhaooy marriages<lb />higher among oersons in the mi-<lb />litary than it is in civilian<lb />life or does it just apovear that<lb /><lb />way? It is our contention that<lb /><lb />this isa valid theory and that<lb />it is the callous outlook of the<lb />military that makes it so. Une<lb />aqeniably, family seoaration is<lb /><lb />"_<lb /><lb />Their marriages<lb />are almost<lb /><lb />doomed to failure.<lb /><lb />a part of the military, and due<lb />to the entire conceot of what<lb />the military's job is, such a<lb />separation may, at times, be un-<lb />avoidable. This is not, howe<lb />ever, any excuse for the army's<lb />sk of concern over the exist-<lb />ing situation, and, most emoha-<lb />tically, the army's use of this<lb />situation as a ounetive messure<lb />cannot to any extent be condoned<lb />by resoonsible and sane indivi-<lb />duals, whether they be connected<lb />with the service or not.<lb /><lb />Proof of such inhumane oun-<lb />ishment can be shown by the fol-<lb />lowing incident which took polace<lb />just recently in the USAG com-<lb /><lb />mand. Jim Evans, voresentiy work-<lb /><lb />Is the Divorce Rate Higher in the Military?<lb /><lb />ing in Main Post Separations,<lb />lives approximately 147 miles<lb />from Fort Bragg and goes home ev-<lb />ery weekend to visit with his<lb />wife, who due to her job as a<lb />registered nurse is unable to<lb />relocate to the Fort Bragg area<lb />for the short voeriod of time<lb /><lb />Jim has remaining here. Last<lb />weekend, due to home problems,<lb />Jim received pernission to leave<lb />early on a Friday afternoon (will<lb />wonders never cease). In his<lb />rush to get home, he neglected<lb />to sign out On pass and was sub-<lb />sequently snowed in so as to be<lb />unable to re'urn until the fol-<lb />lowings Monday afternoon. Real-<lb />izing that he could not get back<lb />on time, Jim called in Sunday<lb />night and informed both the CQ<lb />and his OIC of the situation and<lb />promised to return as soon as<lb />the roads were clear enoush to<lb />travel. Unfortunately, the de=<lb />lay brought to the attention of.<lb />his OIC tne fact that he had<lb />neglected to sign out (heinous<lb />crime, wot?) and upon his return,<lb />he found himself in with LTC<lb /><lb />John Scullion, USAG conmander.<lb />To hts credit, tie colonel did<lb />not formally sounisn Jim. How-<lb />ever, even thouczh he was cogni-ge<lb />zant that Jim's only contact<lb />with his wife was thronzh week=<lb />end oasses and that these weekly<lb />visits were extremely imoortant<lb />to both of them, the colonel re-<lb />stricted Jim to the Post fora<lb />oeriod which ouroosely included<lb />two weekends in a row. If this<lb />is not considered sadism end men-<lb />tal cruelty, not only to Jin,<lb />but to his wif2?, wno was not<lb />guilty of any infraction, then<lb />it is time to start changing the<lb />definitions in our dictionaries.<lb />Through the imposition of this<lb />cruel and unjust form of punish-<lb />ment to Jim and his wife, LTC<lb /><lb />Does the Army have<lb />the right to destroy<lb /><lb />a family or marriage?<lb /><lb />Scullion has once again demon-<lb />strated the callous lack of re-<lb />gard that the arny has for the<lb />needs and oroblems of its men,<lb /><lb />and in doing so has reaffirmed<lb />the need for drastic reforms<lb /><lb />within the military structure<lb />to make it more liveable for the<lb /><lb />people presently suffering under<lb />its unyielding ane dictatorial<lb />thumb of suvoression and misjus-<lb /><lb />ticee<lb /><lb />Perheps if more actions of this<lb />nature were brouzht to lizht, oub-<lb /><lb />lic outery over such inhumanity<lb />would bring about the major chan-<lb />ges which are needed so badly.<lb />The-army must be changed from an<lb />unfeelinz war machine which mea-<lb />sures its success in kill ratios<lb />and casualty rates. Kindness,<lb />understandins, and basic human<lb />rights cannot be alien terms to<lb />be treated with fear and con-<lb />temot by our military leaders.<lb />Nor can the army be oermitted to<lb /><lb />deny such conceots by saying they<lb /><lb />are seditious and therefore de=-<lb /><lb />trinmental to the military's effi-<lb /><lb />ciency as an organization dedi-<lb />cated to killing and genocide.<lb /><lb />Wars are harsh and inhumane,<lb />but does the army that fights<lb />them have to be the same? And<lb />does the arny have the right to<lb />make whole families suffer in or-<lb />der to ounish one GI whose in-<lb />fraction (as it was in Jim's<lb />case) was orobably minor and al-<lb />most alwavs unoremeditated?<lb /><lb />And most imoortant, for it 1s<lb /><lb />a moral issue as well as a so=-<lb />cial one, wnen is the army with-<lb />in its riehts to destroy a fami-<lb /><lb />ly or a marriage simply to achieve<lb /><lb />its own ends?
