In regard to the Case Tobacco <lb />
Transplanter will say; that I am <lb />
pleased with it. couldn't ask for <lb />
one to work any better and it was just <lb />
as you represented it to be. It worked <lb />
perfection and I am satisfied it save <lb />

I set my entire crop of seven acres <lb />
with It and it was dry weather when <lb />
I set it. I used six barrels of water <lb />
setting. I set some parts <lb />
per acre and got a perfect stand the <lb />

the trial of S. M. Pol. <lb />
lard, for murder in the second degree <lb />

hour only one witness took the <lb />
this one being Dr. U. S. for <lb />

The testimony of Dr. Morrill was a I <lb />
He stated that about o'clock <lb />
Saturday night January he <lb />
ed u phone message to come to the <lb />
home of T. Smith and that he <lb />
rived there about ten minutes later. <lb />
his arrival he found Smith with <lb />
u pistol shut wound in the left side of <lb />
the abdominal region. Smith asked <lb />
him for help. He told Smith that there <lb />
was nothing that could be done unless <lb />
he could get him to a hospital where <lb />
he could undergo an operation. To <lb />
this Smith replied that he would <lb />
die at home than in the hospital. <lb />
Smith then told Dr. Morrill how the <lb />
shooting occurred which as he stated <lb />
was as <lb />
That he entered the store of S. M <lb />
Pollard and that Pollard said to him. <lb />
get out of here, get out of <lb />
He then stated that he asked <lb />
what for, and that without other words <lb />
Pollard drew his revolver and tired <lb />
fatal <lb />
Dr. Morrill testified that Smith w e- <lb />
carried to the Washington hospital <lb />
on the midnight train, where he died <lb />
about six o'clock Sunday morning, <lb />
made no other statement than the <lb />
above mentioned. <lb />
After the cross examination of the <lb />
witness by counsel for the defense. <lb />
Judge Daniel ordered that court <lb />
u until morning. <lb />
After court had adjourned and <lb />
jury retired, counsel for the defense <lb />
applied to Judge Daniels, under a <lb />
writ of habeas corpus, for the release <lb />
of Pollard under bond in the sum of <lb />

Pollard standing- by the with <lb />
a gun in his hand and heard him say <lb />
out of to Smith and at <lb />
that moment shot him. Upon cross- <lb />

The fifth called was H. II. Howard, <lb />
also an eye-witness. He stated that <lb />
he was in Pollard's drug store on <lb />
Saturday night Jan. 17th. standing by <lb />
side of counter, and that Flowers. <lb />

all the boys were at a punch hour. <lb />

Vance Belcher, who testified that <lb />
he known Pollard for several <lb />
years and that he had known Smith <lb />
for about the same length of time. <lb />
That he had heard of the trouble <lb />
between Smith and Pollard at the <lb />
barber shop on Saturday night, Jan. <lb />
That on Sunday. Jan. 11th, <lb />
in the presence of Mrs. J. P. <lb />
Taylor Smith told him that he <lb />

the night before and that Pol <lb />
lard had cold feet and wouldn't <lb />
resent it. He further states that <lb />

shop. he. went in <lb />
barber shop. That in a few min- <lb />
he heard someone call for <lb />

found Pollard and Smith clinch- <lb />
ed. holding the breach <lb />

lowing the assembling it was <lb />
that as this court would not finish its <lb />
case until the middle of this week, the <lb />
sheriff should telegraph the sheriff <lb />
of county stating that Judge <lb />
Daniels would not be there to begin <lb />

of L. E. Flowers, a former witness, <lb />
testified that he saw his brother on <lb />
Sunday night following the homicide <lb />
and that his brother told him the fol- <lb />
he was in a drug store <lb />

board when Chief of Police Smith <lb />
came in and walked down the center <lb />

this interval Smith drew a pistol from <lb />

standing by tin cigar case. He asked <lb />
Pollard what had caused the trouble <lb />
and Pollard told him that he had shot <lb />
Smith in order to keep from being kill <lb />

The next witness to testify this morn <lb />
was J. R. Hinson who stated. <lb />
That he had known both the <lb />
and deceased for years. That on <lb />
Monday morning prior to homicide he <lb />
was in Farmville and that Smith go, <lb />
up on wagon with him and told him <lb />
that he had tackled one of the big <lb />
lies the Saturday night -d that <lb />
it was Sam Pollard. That he then <lb />
told Smith that he and Pollard would <lb />
have some trouble if he didn't watch <lb />
out. That Smith said that if Pollard <lb />
began shooting off his lip again or <lb />
bothered him that he was going to <lb />
kill him and that Pollard knew he <lb />

down town and purchased two <lb />
night shirts for Smith and <lb />
back to Smiths house. He <lb />
then asked by Mayor Turnage <lb />
to serve as police that night and <lb />

Robert Little the next witness <lb />
for the defense That he <lb />
lives near th town of Farmville. <lb />
Thai on Saturday evening of Jan <lb />
he saw Smith behind Pol <lb />
lards store n Farmville and held <lb />
the conversation with <lb />
hint. Smith him if he had <lb />
any whiskey that he had some <lb />
trouble that he needed a <lb />
drink. That the two went to a <lb />
nearby stables when they took <lb />
a drink. That Smith told him <lb />
that he had cursed the man out <lb />
that runs that building <lb />
that <lb />
he was going to kill him yet. That <lb />
on Sunday following he was in <lb />
Farmville and that he heard <lb />
I the tragedy then. <lb />
I. K. next witness <lb />
saying <lb />
again any way <lb />
Smith and carried him toward the <lb />
door and upon the door he <lb />
drew a revolver from his left hip pock <lb />
at and fired at Pollard. Pollard states <lb />
that he kept eyes upon Smiths hands <lb />
from time he entered until shot was <lb />
fired. Says to have had four notices <lb />
during the week that said that he was <lb />
going to kill him. Names of men <lb />

j W. Moore and Cameron Smith <lb />
had made personal threat Saturday <lb />
before. Pollard was in barber shop <lb />
and Askew asked how hog case was <lb />
coming on. Pollard said that Cox for Hie defense that <lb />
up something but that if f o'clock Saturday night, Jan- <lb />
proved all knew about Cox that <lb />
barber shop. he and W. C. <lb />
Askew were in the barber shop talk- <lb />
of a hog case which he had in <lb />
court and that he remarked that ho <lb />
would come out alright unless Cox <lb />
tried to gel up him, <lb />
and that if this was done that he <lb />
could get old man down <lb />
there and prove things on Cox that <lb />
would cause him to lose his <lb />
That Smith who had be-en <lb />
listening to the conversation went out <lb />
and in a few minutes he and Cox re- <lb />
turned. Cox asked Pollard what he- <lb />
had been saying about him. Pollard <lb />
told that he knew that Smith was <lb />
the one that had told him this. He <lb />
turned to Smith and he and Smith <lb />
then passed curse words and then Cot <lb />
joined in the discussion and Pollard <lb />
rose to strike Cox. That Smith grab <lb />
bed him by the arm and carried him <lb />
to the street all the while <lb />
him. He then went a part the way <lb />
home with him and told him if be did <lb />
not go on that he was going to kill <lb />
The witness also that <lb />
the week prior to the homicide <lb />
that her husband took every <lb />
to avoid Smith and that he re- <lb />
at home most of the time <lb />
that during this time many reports <lb />
of threats made by were <lb />
to him. She further testified that on <lb />
the night of the homicide her <lb />
band came home and told th <lb />
whole story of the tragedy and he <lb />
remarked to her that he did it In <lb />
self defense and that when the officers <lb />
wanted him thy could find at <lb />
home. <lb />
Church L, Perkins testified that he <lb />
was working in drug store <lb />
in Farmville the night of the <lb />
That on Saturday night. Jan- <lb />
about o'clock he was clean- <lb />
up soda fountain, Pollard was <lb />
attending to the punch board where <lb />
several boys were playing. Smith en <lb />
and walked down toward rear. <lb />
That someone called for a package of <lb />
cigarettes and Pollard turned and <lb />
went to cigar case and wailed upon <lb />
customer. That Smith walked over <lb />
toward where Pollard was standing. <lb />
Pollard said I told you that <lb />
didn't want you around here, get <lb />
Smith stepped forward toward Pol- <lb />
lard trying at the same time to get <lb />
his hand In his pocket as if for a pis- <lb />
At this moment Pollard fired. <lb />
Smith reached forward and grasped <lb />
the of the revolver, the two <lb />
clinched and a second shot fired. That <lb />
at this time he ran from store <lb />
to homicide and that he saw Smith <lb />
That Smith seemed to be mad and <lb />
he asked him what was th- trouble <lb />
and that Smith replied Pollard <lb />
didn't want to treat him right and <lb />
that he was going to kill him if he <lb />
didn't begin treating him right and <lb />
that during this time he <lb />
profane language in regard to Pollard. <lb />
That be went into Monroe Cameron's <lb />
place collect a bill and that he <lb />
told someone in the store that they <lb />
had better tell Pollard to watch out <lb />
that Smith was going to kill him. <lb />
That he went back to Washington and <lb />
that on the following Sunday morn- <lb />
some one stopped hint on the <lb />
street and asked him if he knew tin- <lb />
druggist in Farmville. saying that In- <lb />
had killed the Chief of Police there. <lb />
That he asked them if it was Pollard <lb />
and that they sail that they <lb />
he was the one <lb />
That he then replied that he <lb />
was nut surprised for Smith had toll <lb />
him hat he was going to kill Pollard <lb />
and that he supposed that Pollard had <lb />
gotten instead. <lb />
John testified, that he lived <lb />
in Washington. That on Sunday morn <lb />
following the homicide that he <lb />
saw Eason on the street in Washing <lb />
ton and asked him If he knew the <lb />
drug Mores in Farmville, that one Of <lb />
the druggists had killed the Chief of <lb />
Police there. That Eason remarked <lb />
that be bet that Pollard did it. for <lb />
Smith had told him that he was go <lb />
to kill Pollard and that he re- <lb />
marked that he had better watch out <lb />
or he would die with his shoes on. <lb />
The next witness was <lb />
Cameron, who testified that he had <lb />
been living in Farmville for <lb />
years. That he was in the market <lb />
business in Farmville. That during <lb />
this time he had served eight months <lb />
on the roads for selling liquor. <lb />
on Tuesday prior lo the homicide Fas- <lb />
came to his home and told him <lb />
son a said to have been u,,. There are about seven <lb />
by T. H. Smith. That the wound for and <lb />
the back a few inches to the left . <lb />
Of the spine. That Smith was <lb />
and turned over to the Sheriff. That <lb />
a few days later Dr. Joyner had body <lb />

K E. Belcher testified that he was <lb />
I Justice of Peace and that he <lb />
defendant and had known de- <lb />
ceased. That during November Court <lb />
1913 that Mr. asked him <lb />
and Smith why they did not break <lb />
up the gambling and liquor selling by <lb />
Pollard in Farmville. That he had <lb />
been in Farmville the night before <lb />
noon day meal the trial of S. M. Pol- <lb />
lard progressed rather slowly on ac- <lb />
count of several points made by wit- <lb />
and upon which the counsel for <lb />
and that the ladies of the town had <lb />
him of the same and had re- <lb />
quested him to have such broken <lb />
u and that as officers of the laws it <lb />
would have his licenses. Cox came m <lb />
and told Pollard he wanted to see him. <lb />
Asked Pollard what he had been say <lb />
about him. Pollard said that <lb />
Smith had told him Smith said <lb />
yes and h e was man enough to back <lb />
It up He claims that Smith cursed <lb />
him later Cox told him that he <lb />
would give him five dollars to bring <lb />
down there. Pollard told <lb />
him that he had better bring him <lb />
on a note he had collected for <lb />
Cox called him a damn liar, Pol <lb />
lard got up; Smith grabbed him by <lb />
arm and carried him out. Pollard <lb />
told him that he had treated him <lb />
wrong. Smith him if he Smiths overcoat <lb />

store in playing a <lb />
punch hoard. That there were a <lb />
number of engaged in tins, <lb />
Smith entered and that one <lb />
of the boys asked Smith to have <lb />
a punch and that he said that he <lb />
did not want to punch any. Smith <lb />

Pollard went to the cigar show <lb />
case. That Pollard and Smith <lb />
hail some few and that <lb />
Pollard out of and <lb />
that Smith shall at <lb />
the same <lb />
hand for his pistol and B <lb />

said that he cursed Pollard out <lb />

said and that Smith said on <lb />
that he cursed Pollard out <lb />
day and that he was afraid to resent <lb />

and Pollard drew his pistol fired <lb />
on Smith and that upon this <lb />

watched through the window <lb />

hat he did not return until the two <lb />
men had been separated. <lb />
W. C. testified that he knew <lb />
the defendant. That he also knew <lb />
the deceased. That he married the <lb />
sister of Mrs. Pollard. That on <lb />
night prior to homicide that <lb />
he went to barber shop and met Pol- <lb />
lard and they started a conversation <lb />
in regard to a case which Pollard ha . <lb />
in court. Pollard said that Cox was <lb />
making himself busy about the <lb />
and that he thought that he I <lb />
have to get old man Yelverton down <lb />
there to show Cox up. That he went <lb />
on home and that on Sunday morning <lb />
he heard that Smith and Pollard bad <lb />
some difficulty. That during the after <lb />
air and Pollard told him that Smith <lb />
followed him a part the <lb />
home cursing him all the way. That <lb />
on Saturday night January he had <lb />
gone to the barber shop to get a shave <lb />
and he heard two shots fire and saw <lb />
a crowd rush up In front of Pollard's <lb />
drug store He went to the store <lb />
where h found Smith and Pollard <lb />
ere clinched. He rushed h followed <lb />
time reaching his right noon he asked Pollard about the <lb />
on <lb />
what Smith had said about the <lb />
of Saturday night before and that <lb />
Smith had said that he was going to <lb />
kill Pollard. That requested <lb />
him to notify Pollard of what he <lb />
heard. That on Thursday Smith saw <lb />
him and asked if he had heard <lb />
of the trouble which he had had with <lb />
Pollard. That he replied that he <lb />
heard something of the That <lb />
Smith then said that ho cursed <lb />
Pollard just like be to i <lb />
that if Pollard had crooked tail a <lb />
move at him that he would have <lb />
him. That he went to Pollard <lb />
and that Pollard was not at home and <lb />
it was not until Saturday morning <lb />
he saw him. That he then told <lb />
him what Eason had told him and <lb />
cautioned h'm to be the look out. <lb />
The fifth witness was George K. <lb />
whose testimony he <lb />
in Farmville and he has <lb />
known both defendant and deceased <lb />
for several years. That he bad been <lb />
in to Pollard for about ten <lb />
and that he knew <lb />
tat ion to be good. <lb />
J. B. James he knew <lb />
both defendant and deceased. That In- <lb />
held a conversation with Pollard a <lb />
few days prior to homicide. That be <lb />
was in his office, and Pollard came <lb />
and said that In- wanted to talk to <lb />
him both as mayor and as a lawyer <lb />
said that he was in the barber <lb />
shop the Saturday night before discus <lb />
slug a hog case. That something was <lb />
said in regard lo Cox. That Chief <lb />
Smith went out and that in a few min- <lb />
that Cox came in and asked what <lb />
he had said about him. That he sad <lb />
that be knew that Smith had told him <lb />
He didn't think that he <lb />
was using much judgment as an of <lb />
of the law by trying to cans- a <lb />
both tin- use- prosecution <lb />
length. In each Instance tin- <lb />
jury retired to an adjoining room, and <lb />
this is the way the a majority <lb />
of the forenoon, going to and fro. <lb />
At the convening this afternoon the <lb />
practice was taken up. <lb />
It is thought, although it is not con- <lb />
that all testimony will be heard <lb />
by sometime tomorrow morning, then <lb />
immediately following will com the <lb />
argument by the attorneys. <lb />
At yesterday afternoon t <lb />
the Pollard trial, the first witness be- <lb />
S. V. Joyner, who testified that he <lb />
knew both defendant and deceased. <lb />
That he knew general <lb />
to be good. That he knew that <lb />
Smith killed Simon Tyson and that <lb />
bad. <lb />
J. H. Manning, testimony. That lie <lb />
knew S. If. Pollard but did not know <lb />
his general character or reputation. <lb />
That he had known tin- <lb />
Smith, and reputation for be- <lb />
a violent and dangerous man to be , <lb />
bad. That he was present when <lb />
Smith killed Simon and that <lb />
Tyson was shot in the back while run- <lb />
was their duty. That he has talked <lb />
to Pollard since he has been in jail. <lb />
That since the homicide be had held <lb />
n conversation with Vance Belcher <lb />
and Vance Belcher stated that be <lb />
thought it to be one of the most cold <lb />
murders he had ever known <lb />
of. That Vance Belcher stated that he <lb />
talked to Smith a minutes <lb />
homicide and that he said that at <lb />
time Smith seemed to be in a <lb />
very good humor and that he did <lb />
not think Smith come into Pol- <lb />
lards store expecting to hurt him. <lb />
lie stated that he thought that if such <lb />
had been Smith's Intentions he <lb />
have gotten Pollard before de- <lb />
fired his gun. This <lb />
being a direct contradiction of <lb />
tin- testimony of Vance Belcher given <lb />
on the stand a few days ago, Judge- <lb />
Daniel's that the testimony <lb />
en by Vance- be stricken <lb />
from tin- re-cords. <lb />

he- bad known Pollard several years <lb />

though the bill against Alexander <lb />
was not brought until after Finger <lb />
had gone before that body and told <lb />
the story of the crime. <lb />
When the true bill was brought <lb />
against Finger, Solicitor Clement or- <lb />
that Finger be carried <lb />
the grand jury and make whatever <lb />
statements lo them that he wanted to <lb />
regarding the crime. The prisoner in <lb />
fell statements to the grand jury con. <lb />
leased to being present when the <lb />
crime WM committed and he gave <lb />
