Abstract:
The Supreme Court ruled in FTC vs. Actavis, that courts are required to apply a rule of reason analysis in determining whether a reverse payment settlement violates antitrust laws. The reverse payment settlement, which is unique to pharmaceutical litigation, enables a patent-holder to maintain exclusivity in the relevant market and keep prices higher than they would or should be.

Patent trolls or patent assertion entities buy an arsenal of patents and generate income by asserting infringement of their intellectual property. Banks and businesses in North Carolina have been responding to these patent trolls and defending patent rights. North Carolina Attorney General Roy Cooper expressed support for the Federal Trade Commission’s proposed nationwide investigation of patent trolls.

Abstract:
Clinton E. Lincoln was a resident of Morehead City in between 1854 and 1918. Lincoln patented two inventions during his residency—a sewing table and associated spool holder. The table is exemplary of innovative trends in 19th century daily life, as it would have improved household clothing manufacture. A copy of the patent letter is included in the article.
